A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-3890 SO AS TO PROHIBIT PERSONS UNDER FIFTEEN YEARS OF AGE FROM STANDING OR SITTING IN THE OPEN BED OF A PICKUP TRUCK OR TRAILER UNDER CERTAIN CIRCUMSTANCES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 56-5-3890. It is unlawful for a person under fifteen years of age to stand or sit in the open bed of a pickup truck or trailer while it is traveling in excess of twenty-five miles an hour on a public road or highway. The operator of a motor vehicle who permits a person under fifteen years of age to ride in the open bed of a pickup truck or trailer in violation of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than twenty-five hundred dollars or imprisoned not more than thirty days, or both. This section does not apply to persons riding in organized hay rides or parades."

SECTION 2. This act takes effect upon approval by the Governor.
