TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 1-11-470, SO AS TO REQUIRE THE BUDGET AND CONTROL BOARD TO SUBMIT REGULATIONS TO THE GENERAL ASSEMBLY PROVIDING FOR THE PRIVATIZATION OF CONTRACTUAL SERVICES FOR STATE GOVERNMENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 1-11-470. (A) As used in this section, `privatization' means action by a state agency to contract with the private sector or with another state agency to perform functions or services currently being performed by it.
(B) Within one hundred eighty days from the effective date of this section, the State Budget and Control Board shall promulgate, pursuant to the provisions of Chapter 23 of Title 1, regulations concerning the privatization of state government service which shall include, but are not limited to:
(1) a cost comparison of government and nongovernment service provider before letting of contract;
(2) early monitoring of contractor's performance and periodic monitoring;
(3) uniform rules for procurement of contractual services for all state agencies;
(4) special provisions for nonprofit organization bidding procedures;
(5) security of present state employees and utilization of their services;
(6) limitations on state subsidies given to private contractors;
(7) determination of the need for continuous government regulations of certain services; and
(8) an examination of the possibility of covering counties and municipalities that use state funds."
SECTION 2. This act takes effect upon approval by the Governor.
