A BILL

TO AMEND SECTION 59-26-20, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DUTIES OF THE STATE BOARD OF EDUCATION AND THE COMMISSION ON HIGHER EDUCATION IN REGARD TO CERTAIN EDUCATIONAL MATTERS INCLUDING A REQUIREMENT THAT A BASIC SKILLS EXAMINATION BE DEVELOPED WHICH STUDENTS MUST SUCCESSFULLY COMPLETE BEFORE FINAL ADMITTANCE INTO AN UNDERGRADUATE TEACHER EDUCATION PROGRAM, SO AS TO PROVIDE THAT A STUDENT MAY TAKE THIS EXAMINATION MORE THAN THREE TIMES UPON MEETING CERTAIN REQUIREMENTS, AND TO PROVIDE FOR REQUIREMENTS STUDENTS WHO HAVE NOT PASSED THE EXAMINATION MUST MEET IN ORDER TO ENGAGE IN PRACTICE TEACHING.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 59-26-20(e)(2) of the 1976 Code is amended to read:

"(2) Students may be allowed to take the examination no more than three times except as permitted below. Students who have made three unsuccessful attempts at passing the examination but who are within one point of the required number of points in writing, within ten points of the required number of points in mathematics, and within ten points of the required number of points in reading must be granted a fourth attempt upon the institution's verification of the student's involvement in remediation activities. After the third or fourth attempts, those students within two points in reading or mathematics must be granted additional attempts. A student who has not passed the examination may not engage in student teaching unless he has achieved the scores required in this subitem for the retaking of the examination."

SECTION 2. This act takes effect upon approval by the Governor.
