A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-73-733 SO AS TO PROVIDE THAT WHEN AN AUTOMOBILE INSURANCE PREMIUM INCREASE IS CAUSED BY THE ASSESSMENT OF POINTS AGAINST A PERSON'S DRIVING RECORD, THE AMOUNT OF THE INCREASE MUST BE ELIMINATED WHEN SUCH POINTS ARE REMOVED FROM THE DRIVING RECORD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 38-73-733. Notwithstanding any other provision of law, whenever an automobile insurance premium increase has occurred for a person as the result of the assessment of any points against his driving record pursuant to Section 56-1-720, the amount of the increase in such insurance premium must be eliminated when the points giving rise to the increase are removed from the person's driving record."

SECTION 2. This act takes effect upon approval by the Governor.
