TO AMEND CHAPTER 23, TITLE 57, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 19 SO AS TO DESIGNATE A PORTION OF SOUTH CAROLINA HIGHWAY 35 IN DARLINGTON COUNTY AS "OLD CHARLESTON SCENIC HIGHWAY".
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 23, Title 57, of the 1976 Code is amended by adding:
Section 57-23-1010. South Carolina Highway 35 in Darlington County, known as the Old Charleston Road, beginning at the intersection of South Carolina Highway 179, known as McIver Road, to the intersection of South Carolina Highway 35 and Highway 34 in Mechanicsville, approximately nine miles in length, is designated as a scenic highway to be known as `Old Charleston Scenic Highway'. The Department of Highways and Public Transportation, the Department of Archives and History, and the Department of Parks, Recreation and Tourism shall cooperate in the installation of appropriate markers and signs to implement the above designation.
Section 57-23-1020. All off-premises outdoor advertising is prohibited on `Old Charleston Scenic Highway' after the effective date of this article. Any off-premises signs existing on the effective date of this article must be removed within five years of the effective date of this article.
Section 57-23-1030. No trees in excess of a six-inch caliper located within the highway right-of-way of this scenic highway may be removed without the permission of the Department of Highways and Public Transportation upon the recommendation of the governing council of Darlington County."
SECTION 2. This act takes effect upon approval by the Governor.
