TO AMEND SECTION 44-79-20, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS IN THE PHYSICAL FITNESS SERVICES ACT, SO AS TO REVISE THE DEFINITION OF PHYSICAL FITNESS SERVICES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 44-79-20(1) of the 1976 Code is amended to read:
"(1) `Physical fitness services' means facilities or services for the development of physical fitness through exercise or weight control. The term includes the facilities and services of health or exercise centers, clubs, studios, or classes; health spas; weight control centers, clinics, or studios; figure salons; tanning centers; and athletic or sport clubs. It does not include rehabilitative therapy administered by a licensed physical therapist. As used in this section, `tanning centers' does not include barbershops registered pursuant to Section 40-7-170 or beauty salons licensed pursuant to Section 40-13-170 which offer tanning services or tanning centers which have only one tanning bed."
SECTION 2. This act takes effect upon approval by the Governor.
