A BILL

TO AMEND SECTION 40-39-140, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ACCEPTANCE BY PAWNBROKERS OF PROPERTY TO PAWN, SO AS TO PROVIDE FOR THE RETURN OF LOST OR STOLEN PROPERTY WITHOUT CHARGE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 40-39-140 of the 1976 Code, as added by Act 491 of 1988, is amended to read:

"Section 40-39-140. No pawnbroker shall may accept property from a pledgor upon which there is evidence of ownership by a third party without first taking reasonable steps to ascertain its true ownership. Any Such an item accepted for pawn by a pawnbroker and a lost or stolen item accepted for pawn must be returned on demand without fee to the third party owner."

SECTION 2. This act takes effect upon approval by the Governor.
