A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-1-444 SO AS TO PERMIT LOCAL SCHOOL BOARDS OF TRUSTEES TO ALLOW THE READING OR POSTING OF CERTAIN WRITINGS, DOCUMENTS, AND RECORDS IN THE PUBLIC SCHOOLS OF THE DISTRICT WITHOUT CONTENT-BASED CENSORSHIP THEREOF.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 59-1-444. Local school boards of trustees may allow a teacher or administrator to read or post in a public school building or classroom or at a school event any excerpts or portions of:

(1) the national motto;

(2) the national anthem;

(3) the Pledge of Allegiance;

(4) the preamble and other provisions of the Constitution of this State;

(5) the Declaration of Independence;

(6) the Mayflower Compact;

(7) the writings, speeches, documents, and proclamations of any of the signers of the Declaration of Independence, signers of the 1787 Constitution of the United States, or Presidents of the United States;

(8) the opinions of the United States Supreme Court; and

(9) acts of the United States Congress including published text of the United States Congressional Record.

There shall be no content-based censorship of American history or heritage in this State based on religious reference in such writings, documents, and records."

SECTION 2. This act takes effect upon approval by the Governor.
