A BILL

TO AMEND ACT 813 OF 1946, AS AMENDED, RELATING TO THE CREATION OF THE SPARTANBURG MEMORIAL AUDITORIUM COMMISSION, SO AS TO CHANGE THE COMPOSITION OF THE COMMISSION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 2 of Act 813 of 1946, as last amended by Act 547 of 1947, is further amended to read:

"Section 2. (A) The Spartanburg Memorial Auditorium Commission shall be is composed of six (6) thirteen members who shall be appointed by the Governor for a term of six (6) years, three of whom shall be appointed upon the recommendation of a majority of the Legislative Delegation from Spartanburg County, and three upon the recommendation of the May and a majority of the City Council of the City of Spartanburg, and all of which members at the time of their appointment shall be electors of Spartanburg County, and during their continuance in office shall reside in Spartanburg County. The present members of the commission, namely, T. K. Hudgens, Jr., J. L. Campbell, J. T. Brian, B. E. Gramling, Benj. O. Johnson, and Maurice Puckett, who have heretofore been appointed by the Governor are declared to be members of said Commission as herein established until the terms for which they were appointed shall expire. The successors to such present members of the Commission heretofore appointed by the Governor, shall be appointed in the manner above set forth, except in the case of any vacancy created by the death, disability or resignation of a member before the expiration of his remaining unexpired term of his predecessor. with two of whom serving ex officio as provided in item (3). The commission must be appointed as follows:

(1) Five must be appointed by a special joint committee. The special joint committee shall consist of two members of the Spartanburg City Council, two members of the Spartanburg County Council, and two members of the Auditorium Commission as determined by the respective bodies. The special joint committee shall appoint representatives from the legal profession, the engineering/mechanical profession, the accounting/financial profession, the hospitality industry, and the communications/marketing community.

(2) Two must be appointed by the Spartanburg City Council and four members to be appointed by the Spartanburg County Council.

(3) The Mayor of the City of Spartanburg and the Chairman of the Spartanburg County Council or their designated member of their respective council shall serve as non-voting ex officio members of the Auditorium Commission.

(B) All terms of the appointed members are for four years except that initial appointments may be for less than four years in order to ensure a staggering and rotation of the terms of Auditorium Commission members. No commissioner may serve more than two consecutive full four-year terms. A commissioner is eligible for reappointment after having served two full four-year terms, but may not be reappointed for at least one year following the end of the second consecutive term. Current members of the Auditorium Commission must be appointed to an initial four-year term.

(C) All terms must be staggered and are for four years with the exception that initially five members must be appointed for two-year terms and six members must be appointed for four-year terms. This must be accomplished initially by:

(1) the special joint committee appointing two members for two-year terms and three members for four-year terms;

(2) Spartanburg County Council appointing two members for two-year terms and two members for four-year terms; and

(3) Spartanburg City Council appointing one member for a two-year term and one member for a four-year term. Each current member of the Auditorium Commission must be appointed to one of the four-year terms.

(D) Rules and regulations governing attendance and removal of members from office for absences must be as established by a majority of the special joint committee with the concurrence of the Spartanburg City Council and the Spartanburg County Council. Any vacancies on the commission must be filled in the manner of original appointments.

(E) All members of the Auditorium Commission must be electors of Spartanburg County and during their continuance in office shall reside in Spartanburg County. The Auditorium Commission shall elect one of its members as Chairman and elect such other persons as executive officers as it may determine upon and shall hold such meetings at such times and places as the commission may determine."

SECTION 2. This act takes effect upon approval by the Governor.
