AN ACT TO ESTABLISH THE BOARD OF ELECTION AND REGISTRATION FOR MCCORMICK COUNTY, TO ABOLISH THE OFFICE OF COMMISSIONERS OF ELECTION AND THE REGISTRATION BOARD FOR MCCORMICK COUNTY, AND DEVOLVE THE POWERS AND DUTIES OF THE COMMISSIONERS OF ELECTION AND THE REGISTRATION BOARD UPON THE BOARD OF ELECTION AND REGISTRATION, PROVIDE FOR FILLING VACANCIES, PROVIDE FOR THE APPOINTMENT OF STAFF, PROVIDE FOR THE LOCATION OF THE OFFICE OF THE BOARD, PROVIDE FOR APPROPRIATIONS FOR THE OPERATION OF THE BOARD, PROVIDE FOR NECESSARY OFFICE SPACE, TELEPHONE SERVICE, AND EQUIPMENT FOR THE BOARD, AND TO PROVIDE THAT THE CURRENT MEMBERS OF THE MCCORMICK COUNTY ELECTION COMMISSION AND THE MCCORMICK COUNTY REGISTRATION BOARD SHALL ACT AS THE GOVERNING COMMISSION OF THE NEW MCCORMICK COUNTY BOARD OF ELECTION AND REGISTRATION UNTIL THE MEMBERS OF THE NEW BOARD APPOINTED AS PROVIDED BY THIS ACT TAKE OFFICE, AT WHICH TIME THE TERMS OF THE FORMER COMMISSIONERS OF ELECTION AND REGISTRATION BOARD MEMBERS SHALL EXPIRE.
Be it enacted by the General Assembly of the State of South Carolina:
Board created
SECTION 1. (A) There is created the Board of Election and Registration of McCormick County. There are five members of the board who must be appointed upon recommendation of a majority of the McCormick County Legislative Delegation, including the Senator, who are appointed for terms of four years and until their successors are appointed and qualify, except that initially in order to stagger terms, two members must be appointed for terms of two years. At the expiration of these two-year terms, successors must be appointed for terms of four years. The board shall elect such officers as it considers necessary.
(B) Between the first day of January and the fifteenth day of March of every even-numbered year, the delegation shall appoint the members of the board.
(C) Vacancies on the board may be filled by appointment in the manner of original appointment for the unexpired term only.
(D) Staff may be appointed and may be removed for cause by a majority vote of the members of the board.
(E) The board shall receive an annual appropriation from the governing body of McCormick County in an amount not less than that received for the operation of both the commissioners of election and board of registration for fiscal year 1994-1995.
(F) The office of the board must be located in the county office building unless relocation is recommended by the governing body of the county and approved by a majority of the House members representing a portion of McCormick County and a majority of the Senators representing a portion of McCormick County.
Office and board abolished
SECTION 2. The Office of Commissioners of Election and the Registration Board for McCormick County are abolished. The powers and duties of the Commissioners of Election and the Registration Board are devolved upon the board created in Section 1.
Current members
SECTION 3. The current members of the McCormick County Election Commission and the McCormick County Registration Board shall act as the governing board of the new Board of Election and Registration of McCormick County established pursuant to the provisions of this act until the five members of this board appointed in the manner provided by this act take office. At this time, the terms of these former commissioners of election and registration board members shall expire.
Time effective
SECTION 4. This act takes effect upon approval by the Governor.
