TO AMEND SECTION 8-13-100, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS USED IN THE ETHICS, GOVERNMENT ACCOUNTABILITY, AND CAMPAIGN REFORM ACT OF 1991, SO AS TO INCLUDE WITHIN THE DEFINITION OF "ECONOMIC INTEREST" THE ASSUMPTION THAT A PUBLIC OFFICIAL OR PUBLIC MEMBER HAS AN ECONOMIC INTEREST IN ANY BUDGETARY OR APPROPRIATION MATTER AFFECTING ANY PUBLIC AGENCY BY WHICH THE PUBLIC OFFICIAL OR PUBLIC MEMBER OR MEMBER OF HIS IMMEDIATE FAMILY IS EMPLOYED; AND TO AMEND SECTION 8-13-700, AS AMENDED, RELATING TO PROHIBITING A PUBLIC OFFICIAL FROM USING HIS OFFICIAL POSITION OR OFFICE FOR FINANCIAL GAIN, SO AS TO PROHIBIT A PUBLIC OFFICIAL OR PUBLIC MEMBER EMPLOYED BY ANY PUBLIC AGENCY FROM DELIBERATING OR VOTING ON ANY MATTER AFFECTING THE BUDGET OR APPROPRIATION OF THE PUBLIC AGENCY BY WHICH HE IS EMPLOYED, AND TO PROVIDE AN EXCEPTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 8-13-100(11)(a) of the 1976 Code, as last amended by Act 248 of 1991, is further amended to read:
"(a) `Economic interest' means an interest distinct from that of the general public in a purchase, sale, lease, contract, option, or other transaction or arrangement involving property or services in which a public official, public member, or public employee may gain an economic benefit of fifty dollars or more. A public official or public member is deemed to have an economic interest in any budgetary or appropriation matter affecting any public agency by which the public official or public member or member of his immediate family is employed."
SECTION 2. Section 8-13-700 of the 1976 Code, as last amended by Act 248 of 1991, is further amended by adding:
"(F) No public official or public member who is employed by any public agency may deliberate or vote on any matter affecting the budget or appropriation of the public agency with which he is employed. This subsection does not prohibit a public official or public member from voting on other sections of a general appropriation bill or from deliberating or voting on a general appropriation bill as a whole so long as the public official or public member does not deliberate or vote on the particular agency or section concerning the public agency with which he is associated."
SECTION 3. This act takes effect upon approval by the Governor.
