AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 1-11-425 SO AS TO REQUIRE APPROVAL BY THE STATE BUDGET AND CONTROL BOARD FOR REQUESTS FOR INFORMATION TECHNOLOGY EQUIPMENT AND SERVICES, TO PROVIDE CRITERIA FOR APPROVAL, AND TO ESTABLISH THE INFORMATION TECHNOLOGY ADVISORY COUNCIL TO ASSIST THE BOARD; TO ADD SECTION 59-7-70 SO AS TO REQUIRE THE TRANSFER OF TRANSMISSION AND RECEPTION EQUIPMENT PURCHASED BY SOUTH CAROLINA EDUCATIONAL TELEVISION (SCETV) FOR SCHOOLS TO THE SCHOOL DISTRICTS; TO ADD SECTION 59-7-80 SO AS TO REQUIRE THE SCETV COMMISSION TO DEVELOP CERTAIN REVENUE, INVESTMENT, AND MARKETING PLANS; TO AMEND SECTION 59-7-10, AS AMENDED, RELATING TO THE SCETV COMMISSION, SO AS TO FURTHER DELINEATE CRITERIA FOR MEMBERS; AND TO AMEND SECTION 59-7-20, RELATING TO ADVISORY COMMITTEES OF THE SCETV COMMISSION, SO AS TO REVISE THE ADVISORY COMMITTEE STRUCTURE, TO DIRECT THE SCETV COMMISSION, WITH THE STATE DEPARTMENT OF EDUCATION, TO CONDUCT A STUDY TO EVALUATE THE EFFECTIVENESS OF INSTRUCTIONAL TELEVISION, AND TO PROVIDE THAT THE SCETV COMMISSION IS REAUTHORIZED UNDER SECTION 1-20-60 UNTIL JULY 1, 2003.
Be it enacted by the General Assembly of the State of South Carolina:
Budget and Control Board approval required for purchase of information technology equipment and service
SECTION 1. The 1976 Code is amended by adding:
"Section 1-11-425. The State Budget and Control Board shall approve all requests for information technology equipment and services for state government as defined by the State Procurement Code with exemptions as defined by the board through regulation. In considering requests, the board shall ensure that requests are justified, that duplication among state agencies does not exist, that systems procured provide the most efficient means for providing services and are cost-effective, and that new technologies are compatible with existing technology to the greatest extent practicable. To assist the board, an Information Technology Advisory Council is created. The membership shall include a representative from the Budget and Control Board Division of Operations, the Budget and Control Board Division of Budget and Analysis, the South Carolina Educational Television Commission, the State Department of Education, the Commission on Higher Education, the State Board for Technical and Comprehensive Education, institutions of higher education, and other entities the board considers appropriate. Public members shall serve without compensation or reimbursement of expenses. The Executive Director of the State Budget and Control Board shall appoint the chairman."
Equipment to be transferred to school districts; SCETV required to develop revenue, investment, and marketing plans
SECTION 2. The 1976 Code is amended by adding:
"Section 59-7-70. Ownership of transmission and reception equipment purchased in the past or in the future on behalf of schools by South Carolina Educational Television, as directed by the General Assembly, must be transferred to the school districts. In return, the school districts shall establish and maintain a separate account for these items. All items valued at one hundred dollars or more are subject to audit during the districts' annual audits. Annually, the districts shall report on their respective inventories to the SCETV Commission.
Section 59-7-80. The South Carolina Educational Television Commission shall:
(1) develop and implement a plan to increase revenue generated at each of the regional stations. A report of the regional stations' progress must be submitted to the State Reorganization Commission, Senate Finance Committee, and House Ways and Means Committee no later than January 1, 1998;
(2) annually develop a written plan to maximize the return on its investment in the Satellite Educational Resources Consortium. The plan shall include objective criteria that establish, for each course produced, a threshold level for cost recovery, below which point course production will be discontinued. The plan must be submitted to the Senate Finance Committee and the House Ways and Means Committee;
(3) in conjunction with the State Department of Education, formulate and implement a marketing plan to increase awareness of the Satellite Educational Resources Consortium programs. A copy of the completed plan must be forwarded to the State Reorganization Commission upon its completion. A progress report must be submitted to the State Reorganization Commission, Senate Finance Committee, and House Ways and Means Committee no later than January 1, 1998.
(4) subject to the provisions of Chapter 35 of Title 11, the South Carolina Educational Television Commission attempt to secure a private contractor for the operation of its day care facility in accordance with the National Association for the Education of Young Children (NAEYC) accreditation standards. The commission shall submit a report to the State Reorganization Commission, the Senate Finance Committee, and the House Ways and Means Committee by March 1, 1997, that includes the actions taken and their effects on its day care facility revenues and enrollment, a detailed expenditure report for day care facility operations in calendar year 1996, and an operational budget for day care facility operations in calendar year 1997."
Criteria for membership and appointment
SECTION 3. Section 59-7-10 of the 1976 Code, as last amended by Section 6 of Act 248 of 1991, is further amended to read:
"Section 59-7-10. There is created the South Carolina Educational Television Commission composed of the Superintendent of Education who serves ex officio and seven members to be appointed by the Governor with the advice and consent of the Senate. One member must be appointed from each of the six congressional districts, and one member must be appointed from the State at large, who must be named by the Governor as chairman of the commission. Of the members appointed, one must have experience in public education, one must have experience in higher education, and one must have experience in broadcasting. In making the appointments, race, gender, and other demographic factors must be considered to ensure nondiscrimination, inclusion, and representation, to the greatest extent possible, of all segments of the population of the State. The terms of the members appointed by the Governor are for six years."
Advisory committees authorized
SECTION 4. Section 59-7-20 of the 1976 Code is amended to read:
"Section 59-7-20. The commission shall appoint advisory committees as it considers necessary to assist in fulfilling its mission, each of which shall consist of members as the commission considers advisable, and the terms of the members of the committees are for such length and under such conditions as the commission may decide."
Vacancies
SECTION 5. As vacancies occur on the South Carolina Educational Television Commission, as provided for in Section 59-7-10 of the 1976 Code as amended by Section 3 of this act, members who satisfy the requirements added by these amendments must be appointed to fill these vacancies.
Study on effectiveness of instructional television
SECTION 6. The South Carolina Educational Television Commission, in conjunction with the State Department of Education, shall conduct a joint, comprehensive study to evaluate the effectiveness of instructional television. This study shall include recommendations as to the appropriate placement of instructional television. The study must be submitted to the State Reorganization Commission, Senate Finance Committee, and House Ways and Means Committee no later than January 1, 1997.
SCETV Commission reauthorized
SECTION 7. In accordance with Section 1-20-60 of the 1976 Code, the existence of the South Carolina Educational Television Commission is reauthorized until July 1, 2003.
Time effective
SECTION 8. Except as otherwise specifically provided, this act takes effect upon approval by the Governor.
