A BILL

TO AMEND SECTION 48-39-290, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO RESTRICTIONS AND EXCEPTIONS ON CONSTRUCTION SEAWARD OF THE BASELINE OR BETWEEN THE BASELINE AND SETBACK LINE, SO AS TO PROVIDE AN EXCEPTION TO THE PROHIBITION AGAINST ALLOWING NEW EROSION CONTROL STRUCTURES OR DEVICES SEAWARD OF THE SETBACK LINE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 48-39-290(B)(2) of the 1976 Code, as last amended by Act 29 of 1993, is further amended by adding at the end:

"(f) Subitem (a) does not apply to an island with an Atlantic Ocean shoreline subject to erosion of seventeen thousand four hundred fifty feet, of which seven thousand two hundred feet is protected with existing erosion control devices and ten thousand two hundred fifty feet of shoreline is not protected with existing erosion control devices. Any future plan for construction of erosion control devices on such an island must address all unprotected eroding shoreline and provide for a source of funding for the future maintenance of erosion control devices as may be permitted and constructed pursuant to the plan. Nothing contained in this subitem makes such an island eligible for beach renourishment funds."

SECTION 2. This act takes effect upon approval by the Governor.
