A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 11-1-35 SO AS TO PROVIDE THAT IF ANY STATE AGENCY, DEPARTMENT, OR INSTITUTION OF HIGHER LEARNING DEVELOPS A PRODUCT OR SERVICE, IT MAY SELL THE PRODUCT OR SERVICE ONLY TO PUBLIC SECTOR RECIPIENTS UNLESS THE STATE BUDGET AND CONTROL BOARD AUTHORIZES THE AGENCY, DEPARTMENT, OR INSTITUTION TO MARKET THE PRODUCT OR SERVICE TO THE PRIVATE SECTOR BECAUSE THERE ARE NO OTHER PRIVATE SECTOR VENDORS WITHIN THIS STATE WHO SELL OR MARKET THE SAME OR A SUBSTANTIALLY SIMILAR PRODUCT OR SERVICE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 11-1-35. If any state agency, department, or institution of higher learning develops a product or service, it may sell the product or service only to public sector recipients unless the State Budget and Control Board authorizes the agency, department, or institution to market the product or service to the private sector because there are no other private sector vendors within this State who sell or market the same or a substantially similar product or service."

SECTION 2. This act takes effect upon approval by the Governor.
