A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 6-1-100 SO AS TO PROHIBIT A GOVERNMENTAL ENTITY FROM SELLING AN AGRICULTURAL OR HORTICULTURAL PRODUCT, DEFINE TERMS, AND PROVIDE EXCEPTIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 6-1-100. (A) No governmental entity may sell an agricultural or horticultural product. As used in this section:

(1) `Governmental entity' is defined as in Section 6-15-10(3).

(2) `Agricultural or horticultural product' includes, but is not limited to, sod, turf, and ornamental plants.

(B) This section does not apply to governmental entities involved in turf production on the effective date of this section."

SECTION 2. This act takes effect upon approval by the Governor.
