TO ABOLISH THE COMMISSION OF THE DEPARTMENT OF TRANSPORTATION AND TRANSFER ITS RESPONSIBILITIES TO THE DEPARTMENT'S DIRECTOR; TO AMEND SECTION 57-1-410, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE APPOINTMENT AND THE RESPONSIBILITIES OF THE DIRECTOR OF THE DEPARTMENT OF TRANSPORTATION, SO AS TO REQUIRE THE GOVERNOR TO APPOINT AND REMOVE THE DIRECTOR; AND TO REPEAL ARTICLE 3, CHAPTER 1 OF TITLE 57, RELATING TO THE ESTABLISHMENT AND DUTIES OF THE COMMISSION OF THE DEPARTMENT OF TRANSPORTATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The Commission of the Department of Transportation is abolished on the effective date of this act and its powers, duties, and functions devolve upon the Director of the Department of Transportation.
SECTION 2. Section 57-1-410 of the 1976 Code, as added by Act 181 of 1993, is amended to read:
"Section 57-1-410. The commission shall employ a director who shall serve at the pleasure of the commission. A person appointed to this position shall The Governor shall appoint a director with the advice and consent of the Senate who must be a citizen of practical and successful business and executive ability who has a knowledge in the field of transportation. The director shall receive such compensation as may be established under the provisions of Section 8-11-160 and for which funds have been authorized in the general appropriation act. The director is subject to removal by the Governor as provided in Section 1-3-240."
SECTION 3. Article 3, Chapter 1, Title 57 is repealed.
SECTION 4. This act takes effect upon approval by the Governor.
