A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 14-3-460 SO AS TO PROVIDE THAT THE SUPREME COURT BY RULE SHALL ESTABLISH PROCEDURES WHEREBY CONDUCT WHICH IS DISCOVERED DURING THE COURSE OF AN ATTORNEY OR JUDICIAL GRIEVANCE OR DISCIPLINARY PROCEEDING AND WHICH MAY CONSTITUTE A VIOLATION OF CRIMINAL LAW SHALL BE REFERRED TO THE APPROPRIATE SOLICITOR FOR POSSIBLE PROSECUTION OF THE VIOLATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 14-3-460. The Supreme Court by rule shall establish procedures whereby conduct which is discovered during the course of an attorney or judicial grievance or disciplinary proceeding and which may constitute a violation of criminal law shall be referred to the appropriate solicitor for possible prosecution of the violation. Nothing in this section, however, or in the rule established by the Supreme Court pursuant to this section may violate the attorney-client privilege or other privileges or immunities provided by law."

SECTION 2. This act takes effect upon approval by the Governor.
