A BILL

TO AMEND SECTION 16-25-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CRIMINAL DOMESTIC VIOLENCE, SO AS TO PROVIDE THAT THIS SECTION DOES NOT PROHIBIT REASONABLE DISCIPLINE OF A CHILD IN THE FORM OF CORPORAL PUNISHMENT, RESTRAINT, OR DETENTION AS PROVIDED IN SECTION 20-7-490(C)(1).

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 16-25-20 of the 1976 Code is amended to read:

"Section 16-25-20. It is unlawful to: (1) cause physical harm or injury to a person's own household member, (2) offer or attempt to cause physical harm or injury to a person's own household member with apparent present ability under circumstances reasonably creating fear of imminent peril. This section does not prohibit reasonable discipline of a child in the form of corporal punishment, restraint, or detention as provided in Section 20-7-490(C)(1)."

SECTION 2. This act takes effect upon approval by the Governor.
