STATEMENT FOR JOURNAL--RE AMENDMENT NO. 5

This amendment to the Senate Reapportionment Plan will redress a serious flaw which violates both the spirit and letter of the law contained in the 1965 Voting Rights Act.

First, one of the more significant factors considered by the Justice Department in analyzing compliance is whether or not the proposed plan preserves the sense of community where possible. The Plan currently splits a precinct in north Summerville, leaving 44 voters and moving about 2,800 voters from District 38 (currently held by Senator Rose from Dorchester County) into District 44 (re- numbered but held now by Senator Mescher from Berkeley County). Senator Rose would retain approximately the same number of voters in Berkeley County.

It should be noted that the Dorchester County precinct being transferred to District 44 is called the North Summerville Precinct and is closely tied to the City. In fact, this Precinct contains a large population of senior citizens because of the presence of the Presbyterian Home there. These residents participate actively in all aspects of community life, including the election of local officials. The impact on these senior citizens is severe because the Senate Plan will give them a non-resident senator who lives outside the community. These elderly people will have to make a long distance call to communicate with their senator.

Second point. Senator Rose actually made this point in advocating a lawsuit that challenged the Delegation system in Dorchester County. Senator Rose complained about the inequity in the voting strength between Representative Gilda Cobb-Hunter who then represented 187 voters in Dorchester County and his voting strength (the same) when he represented many thousands of voters. The Rose challenge to the Delegation system has been responsible for holding up many appointments to the deteriment of the best interests of the people. It is my understanding that this has been made a class action so the outcome of this lawsuit will be imposed on all the counties of the State.

In view of Senator Rose's position on voting strength and the lawsuit, the switch of the North Summerville precinct from Senator Rose to Senator Mescher is hypocritical because it gives Senator Mescher a

toehold in Dorchester County for the purpose of gaining a position on the Dorchester Delegation with a full vote. That is exactly what Senator Rose complained about but chose to use that method when it was convenient.

It is morally wrong to use people as pawns in the political process. We are elected to put the good people of South Carolina first.

Each of you has a copy of Colonel Buell's letter to the editor of our local paper. In case you have not had the opportunity to read it, I want to tell you a little bit about this remarkable gentleman who resides in the disputed precinct before reading an excerpt from his letter.

Colonel Buell is almost 95 years old. At the request of general Douglas MacArthur, he went to Korea after the war, met with Sygman Rhee and his staff on certain problems and then went to Japan to deliver his report which he did personally. General MacArthur was so impressed that he invited Colonel Buell to join his staff. Colonel Buell and his deceased wife were both graduates of the College of Charleston and both retired after illustrious careers in the Army.

This is what Colonel Buell had to say about the Rose/Mescher portion of the Senate Reapportionment Plan. (Read Excerpt).

I have been impressed when many of you, such as Jim Hodges, have shared where you acquired your values. I want to share with you some values I learned about 45 years ago in high school when one of the visiting ministers, Bishop Kerney, spoke at our weekly assembly. He said, "You should not use people and love things; you should love people and use things."

Most of my values were learned as a child from my roots here in South Carolina but one good value that I acquired at West Point is contained in the Cadet Prayer and that is a plea to be given the strength to do the harder right instead of the easier wrong. That is my prayer for you today.
