Senator BRYAN proposed the following amendment (PFM\7442BDW.95), which was adopted:

Amend the bill, as and if amended, by adding an appropriately numbered SECTION to read:

/SECTION ___. A. The 1976 Code is amended by adding:

"Section 50-11-80. (A) Without permission of the owner and occupant, it is unlawful to hunt:

(1) big game within three hundred yards of a residence;

(2) small game within one hundred yards of a residence.

(B) A person violating this section is guilty of a misdemeanor and, upon conviction, must be fined not more than two hundred dollars or imprisoned not more than thirty days.

(C) This section does not apply to a landowner hunting on his own land."

B. Section 50-11-355 of the 1976 Code is repealed./

Renumber sections to conform.

Amend title to conform.

IS GUILTY OF THE OFFENSE OF CHILD ENDANGERMENT AND MUST BE PENALIZED BY A MANDATORY FINE OR IMPRISONMENT NOT LESS THAN ONE-HALF OF THE MAXIMUM FINE OR IMPRISONMENT GIVEN FOR THE ORIGINAL OFFENSE, AND TO PROVIDE THAT A PERSON MAY BE CONVICTED OF CHILD ENDANGERMENT IN ADDITION TO THE OTHER OFFENSES.

The Senate proceeded to a consideration of the Bill. The question being the adoption of the amendment proposed by the Committee on Judiciary.

The Judiciary Committee proposed the following amendment (JUD3037.004), which was adopted:

Amend the bill, as and if amended, page 1, beginning on line 34, in Section 56-5-2947(A), as contained in SECTION 1, by striking lines 34 and 35 in their entirety and inserting therein the following:

/(2) the person has one or more passengers under sixteen years of age in the motor vehicle when the violation occurs.

If more than one passenger under sixteen years of age is in the vehicle when a violation of subsection (A)(1) occurs, the person may be charged with only one violation of this section./.

Amend the bill further, as and if amended, page 2, line 21, by striking SECTION 2 in its entirety and inserting therein the following:

/SECTION 2. The 1976 Code is amended by adding:

"Section 56-1-385. (A) Notwithstanding any other provision of law, a person whose driver's license or privilege to operate a motor vehicle has been suspended or revoked for a continuous period of five or more years may apply to the Department of Public Safety to become eligible to receive a driver's license from the Department of Revenue and Taxation. To obtain a driver's license pursuant to this provision:

(1) the five years immediately before filing the application must have passed without a traffic or other violation which resulted in action against the person's driver's license;

(2) the five years immediately before the filing of the application must have passed without the person being convicted of an alcohol or other drug violation;

(3) if the person's driver's license or privilege to operate a motor vehicle was under suspension or revocation by the Department of Public Safety during the five years immediately before the filing of the application for a violation of Sections 56-1-745, 56-1-746, 56-5-2930, or 56-5-2945, or for the violation of another provision of this State, another

state, or a foreign jurisdiction related to alcohol or drugs, the person must have completed successfully an alcohol or drug assessment and treatment program provided by the South Carolina Department of Alcohol and Other Drug Abuse Services or an equivalent program designated by that agency; and

(4) the person's overall driving record, attitude, habits, character, and driving ability would make it safe to grant him the privilege to operate a motor vehicle.

(B) If a person's privilege to operate a motor vehicle is restored pursuant to this section, a subsequent violation of any law or ordinance of this State, another state, or foreign jurisdiction which would result in the imposition of six or more points pursuant to Section 56-1-720 or mandatory revocation or suspension of a driver's license will require the cancellation of the person's driver's license and the imposition of the full period of suspension and revocation for a previous violation."

SECTION 3. This act takes effect upon approval by the Governor./.

TO AMEND ARTICLE 11, CHAPTER 7, TITLE 20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DISPOSITION OF CASES BEFORE THE FAMILY COURT, BY ADDING SECTION 20-7-1530 SO AS TO PROVIDE FACTORS WHICH MUST BE CONSIDERED IN DETERMINING THE CUSTODY OF MINOR CHILDREN; AND TO ADD SUBARTICLE 2 SO AS TO PROVIDE FOR SPECIAL VISITATION PROVISIONS WHICH A COURT MAY ORDER WHEN AWARDING VISITATION IN CASES INVOLVING DOMESTIC AND FAMILY VIOLENCE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Subarticle 1, Article 11, Chapter 7, Title 20 of the 1976 Code, as last amended by Act 395 of 1994, is further amended by adding:

"Section 20-7-1530. In making a decision regarding custody of minor children, the court must give weight to the following factors:

(1) the best interests of the child;

(2) the fitness of the parties;
