PART II PAGE 562 1 DELETE REFERENCES TO THE STATE REORGANIZATION COMMISSION; AND TO REPEAL CHAPTERS 19, 20, AND 2 22 OF TITLE 1, RELATING TO THE ESTABLISHMENT OF THE STATE REORGANIZATION COMMISSION, REVIEW 3 OF STATE AGENCIES AND BOARDS, AND THE COMPLIANCE REVIEW ACT OF 1988. 4 5 A. Section 1-25-60(A)(2) of the 1976 Code, as last amended by Section 20, Act 181 of 1993, is further amended to read: 6 7 "(2) Reserved A representative of the State Reorganization Commission, who shall serve as Chairman." 8 9 B. Section 2-15-120 of the 1976 Code is amended to read: 5 6 "Section 2-15-120. All records of the State Reorganization Commission and the Legislative Audit Council with the exception of its 7 final review and evaluation reports provided for by Section 1-20-10 and its final audit reports provided for by Section 2-15-60 shall be 8 are confidential and not subject to public disclosure prior to the publication of the final audit report. The court in determining the extent 9 to which any disclosure of all or any part of a council record is necessary shall impose appropriate safeguards against unauthorized 10 disclosure. 11 As used in this section, records' shall include includes but is not be limited to books, papers, maps, photographs, cards, tapes, 12 recordings, or other documentary materials regardless of physical form or characteristics prepared, owned, used, in the possession of or 13 retained by the Legislative Audit Council and the State Reorganization Commission. 14 Any person violating the provisions of this section shall be is deemed guilty of a misdemeanor and, upon conviction, shall may be fined 15 not more than one thousand dollars or imprisoned not more than one year, or both, in the discretion of the court. If the person convicted 16 is an officer or employee of the State, he shall must be dismissed from office or employment and be is ineligible to hold any public office 17 in this State for a period of five years after such the conviction." 18 19 D. Section 8-13-770 of the 1976 Code, as added by Act 248 of 1991, is amended to read: 20 21 "Section 8-13-770. A member of the General Assembly may not serve in any capacity as a member of a state board or commission, 22 except for the State Budget and Control Board, the Advisory Commission on Intergovernmental Relations, the Legislative Audit Council, 23 the Legislative Council, the Legislative Information Systems, the Reorganization Commission, the Judicial Council, the Sentencing 24 Guidelines Commission, the Commission on Prosecution Coordination, and the joint legislative committees." 25 26 E. Chapters 19, 20, and 22 of Title 1 of the 1976 Code are repealed. 27 28 F. This section takes effect July 1, 1998. 29
