18          37.1.   (CORR: Clothes/Transportation Upon Discharge)  Whenever an inmate shall be discharged from the Department of Corrections,
19     the State Board of Corrections thereof shall furnish such inmate with a suit of common clothes, if deemed
20     necessary, and transportation from the Department of Corrections to his home, if his home be within this State, or to the County from
21     which he was sentenced if his home be without this State.
22          37.2.   (CORR: Farm Program)  Notwithstanding any provision of law to the contrary, the proceeds from the sale of all excess
23     agricultural products produced by the Farm Program of the South Carolina Department of Corrections shall be retained by that agency to
24     be utilized in the expansion and modernization of the program.
25          37.3.   (CORR: Sale of Products)  In addition to sales currently authorized by statute, all articles or products produced by the
26     Department of Corrections may be sold on the open market; those articles or products not provided for by statute, are sold and distributed
27     through wholesalers and jobbers within this State.
28          37.4.   (CORR: Habilitation Unit for Developmentally Disabled)  Notwithstanding any other provision of law to the contrary, the
29     excess revenue generated by the Adult Work Activity Center be returned to the Department of Corrections to be utilized in the expansion
30     and modernization of the Habilitation Unit for the Developmentally Disabled.
31          37.5.   (CORR: Canteen Operations)  Revenue derived wholly from the Canteen operations within the Department of Corrections on
32     behalf of the inmate population, may be retained and expended by the Department for the continuation of the operation of said Canteens
33     and the welfare of the inmate population.  The Canteen operation is to be treated as an enterprise fund within the Department of
34     Corrections and is not to be subsidized by State Appropriated Funds.


SECTION 37 - N04 - CORRECTIONS, DEPARTMENT OF PAGE 455 1 37.6. (CORR: Contract for Services) Upon initiation by the South Carolina Department of Corrections, and upon prior approval by 2 the Budget and Control Board, the Department of Corrections may contract for any and all services, but such services must (1) demonstrate 3 reasonably comparable, cost-effectiveness to traditional methods of construction, (2) result in long-term operational cost-savings, (3) result 4 in the provision of a new facility of sufficient bed, program, and support space more expeditiously than traditional methods, and (4) be 5 subject to the year-to-year appropriation process of the General Assembly and state procurement procedures. 6 37.7. (CORR: Contract Performance Funded Literacy Instruction) Of funds appropriated for the Palmetto Unified School District 7 Contractual Services, $75,000 must be used for contracting with private sector education providers for performance-funded literacy 8 instruction. Contractors would be paid only for student progress on quantifiable performance measurements. 9 37.8. (CORR: E.H. Cooper Trust Fund) Notwithstanding any provision of law to the contrary, the Commissioner of the Department 10 of Corrections, at his discretion, may utilize interest generated from the fund created by interest which accrued to the E.H. Cooper Trust 11 Fund and was retained by the Department of Corrections in prior years. The Commissioner may use these funds for special projects 12 benefitting the general welfare of all inmates in the custody of the Board of Corrections. 13 37.9. (CORR: Work Release Program Transportation Fee) The Department is authorized to charge a one dollar ($1.00) per day 14 transportation fee to participants in the work release program. 15 37.10. (CORR: Instructional Salaries) The certified instructional personnel of the Department of Corrections shall receive a percentage 16 increase in their annual salary for the current fiscal year equal to the percentage allocated to the instructional personnel throughout the 17 State. 18 37.11. (CORR: Recreational Scoreboards and Bleachers) The recreational scoreboards and bleachers determined to be surplus by the 19 South Carolina Department of Corrections may be donated by the Department to the school district in which the donating institution is 20 located. In the event the school district does not have need for such equipment, it may then be offered to any school district within the 21 county in which the institution is located. 22 37.12. (CORR: Funding Through State Criminal Assistance Program) All funds received by the State from the United States 23 Department of Justice, State Criminal Alien Assistance Program, for care and custody of illegal aliens housed in the state correctional 24 facilities shall be retained by the South Carolina Department of Corrections to offset incurred expenses. 25 37.13. (CORR: Medical Expenses) The Department of Corrections shall be authorized to charge inmates for any medical treatment or 26 consultation provided at the request of or initiated by the inmate. Inmates shall not be charged for psychological or mental health visits. 27 37.14. (CORR: Surplus Farm Produce) The Department of Corrections shall be authorized to sell surplus farm produce, with any 28 funds generated to be utilized by the Department to offset costs of the farming operation. 29 37.15. (CORR: Remedial Education Funding) A criminal offender committed to the custody of the Department of Corrections, who 30 has been evaluated to function at less than an eighth grade educational level, or less than the equivalent of an eighth grade educational 31 level, may be required by Department officials to enroll and actively participate in academic education programs. Funds appropriated to 32 the Department of Corrections for educational programs shall be prioritized to assure such remedial services are provided. 33 37.16. (CORR: Tire Retreading Program Restriction) The tire retreading program at the Lieber Correctional Institution shall be limited 34 to the marketing and sale of retreads to only state governmental entities.

(CORR: Site Selection) In determining the site for the construction of new correctional facilities in the state, the Department 2 of Corrections shall give more weight to factors such as economically depressed areas and areas with high unemployment rates. The 3 consideration of these factors shall be done in conjunction with the General Assembly and the Department of Commerce. Any such 4 neglect to consider these factors in the prescribed way will result in beginning the site selection process for the new facility again. 5 37.18. (CORR: Social Security Administration Funding) All funds received by the S.C. Department of Corrections from the Social 6 Security Administration under Section 1611 (e)(1)(I) of the Social Security Act, which provides payment for information regarding 7 incarcerated Social Security Insurance recipients, shall be retained by the S.C. Department of Corrections and credited to the E.H. 8 Cooper Trust Fund for the care and custody of inmates housed in the state correctional facilities. 9
