24     TO AMEND CHAPTER 7, TITLE 1 OF THE 1976 CODE, RELATING TO THE ATTORNEY GENERAL, BY ADDING
25     SECTION 1-7-85 SO AS TO PROHIBIT THE USE OF CERTAIN APPROPRIATED FUNDS AND TO REQUIRE WRITTEN
26     APPROVAL FROM THE STATE BUDGET AND CONTROL BOARD BEFORE THE ATTORNEY GENERAL MAY
27     CONTRACT ON A CONTINGENT OR OTHER BASIS FOR LEGAL REPRESENTATION; AND TO AMEND SECTION
28     1-7-150, RELATING TO THE ACCOUNTING OF THE ATTORNEY GENERAL TO THE STATE TREASURER, SO AS TO
29     REQUIRE THAT ALL MONIES EXCEPT CERTAIN COSTS AWARDED TO THE STATE OF SOUTH CAROLINA BY
30     JUDGMENT OR SETTLEMENT IN ACTIONS OR CLAIMS BROUGHT BY THE ATTORNEY GENERAL ON BEHALF OF
31     THE STATE OR ONE OF ITS AGENCIES OR DEPARTMENTS MUST BE DEPOSITED IN THE GENERAL FUND OF THE

34     A.  Chapter 7, Title 1 of the 1976 Code is amended by adding:


PART II PAGE 548 1 "Section 1-7-85. The Attorney General may not use the funds appropriated in Part IA, Section 32, Program I, Special Items' for, 2 and may not contract on a contingent or other basis for the legal representation of this State, or any of its departments or institutions, as 3 a plaintiff in a matter on behalf of this State, without first receiving the written approval of the Budget and Control Board." 4 5 B. Section 1-7-150 of the 1976 Code is amended to read: 6 7 "Section 1-7-150. (A) The Attorney General shall account to the State Treasurer for all fees, bills of costs, and moneys monies 8 received by him by virtue of his office. 9 (B) All monies, except investigative costs or costs of litigation awarded by court order or settlement, awarded the State of South 10 Carolina by judgment or settlement in actions or claims brought by the Attorney General on behalf of the State or one of its agencies or 11 departments must be deposited in the general fund of the State, except as required by law." 12 13 C. This section takes effect July 1, 1998. 14
