TO AMEND CHAPTER 13, TITLE 50, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-13-237 SO AS TO ESTABLISH LIMITS ON BLACK BASS TAKEN FROM LAKES MARION AND MOULTRIE AND IN CERTAIN PORTIONS OF THE SANTEE RIVER; AND BY AMENDING SECTION 50-13-210, RELATING TO DAILY CREEL LIMITS ON FISH, SO AS TO CONFORM IT WITH LIMITS ON BLACK BASS FROM LAKES MARION AND MOULTRIE AND IN CERTAIN PORTIONS OF THE SANTEE RIVER.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 13, Title 50 of the 1976 Code is amended by adding:
"Section 50-13-237. It is unlawful to take or possess black bass less than twelve inches in Lakes Marion and Moultrie and in the Santee River from the confluence of the Congaree and the Wateree Rivers to Lake Marion, and it is unlawful to take or possess more than five black bass in any one day from those waters. A person exceeding these limits is guilty of a misdemeanor and, upon conviction, must be punished as provided in Section 50-13-285."
SECTION 2. Section 50-13-210(2) of the 1976 Code is amended to read:
"(2) not more than ten of the total may be black bass (large mouth, small mouth, coosae) or a combination of them, except in Lakes Marion and Moultrie and in certain portions of the Santee River as set forth in Section 50-13-237, or unless regulations promulgated by the department and adopted by the General Assembly by authority of Section 50-13-236 reflect otherwise;"
SECTION 3. This act takes effect upon approval by the Governor.
