A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 42-15-100 SO AS TO LIMIT THE CLERICAL FEE FOR SEARCHING AND HANDLING MEDICAL INFORMATION OR RECORDS UNDER SECTIONS 42-15-95, 44-7-325, AND 44-115-80 TO AN INITIAL, ONE-TIME-ONLY FEE WITH RESPECT TO AN INDIVIDUAL AND ALLOW ONLY POSTAGE AND THE PRESCRIBED COPYING FEE TO BE CHARGED FOR UPDATES OF MEDICAL NOTES OR RECORDS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 42-15-100. Notwithstanding the provisions of Sections 42-15-95, 44-7-325, and 44-115-80 relating to the 'clerical fee for searching and handling not to exceed fifteen dollars per request', this fifteen dollar fee shall be an initial, one-time-only fee for the searching and handling with respect to an individual, after which only postage and the prescribed copying fee shall be allowed for copies of updates of medical notes or records regarding that individual."

SECTION 2. This act takes effect upon approval by the Governor.
