A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-29 SO AS TO PROVIDE THAT A PERSON CONVICTED OF MURDERING A LAW ENFORCEMENT OFFICER IN THE LINE OF DUTY MUST RECEIVE A MANDATORY SENTENCE OF DEATH, TO PROVIDE A SEVERABILITY CLAUSE, AND TO PROVIDE A SAVINGS CLAUSE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-3-29. Notwithstanding another provision of law, a person convicted of murdering a law enforcement officer in the line of duty must receive a mandatory sentence of death."

SECTION 2. If a provision of this act or the application of a provision of this act upon a person or circumstance is held to be invalid, the invalidity does not affect other provisions or applications of this act which can be given effect without the invalid provision or application, and to this end the provisions of this act are severable.

SECTION 3. This act does not affect an action or proceeding commenced or right accrued before the effective date of this act.

SECTION 4. This act takes effect upon approval by the Governor.
