TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-71-146 SO AS TO REQUIRE INDIVIDUAL AND GROUP HEALTH INSURANCE POLICIES AND CONTRACTS ISSUED OR RENEWED ON OR AFTER JULY 1, 1998, TO PROVIDE COVERAGE FOR DIABETES OUTPATIENT SELF-MANAGEMENT TRAINING AND DIABETES EQUIPMENT AND SUPPLIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 38-71-146. (A) On or after July 1, 1998, every individual and group health insurance policy or contract issued or renewed in this State shall provide coverage for the equipment, supplies, and outpatient self-management training and education, including medical nutrition therapy, for the treatment of insulin-dependent diabetes, insulin-using diabetes, gestational diabetes, and noninsulin using diabetes if prescribed by a health care professional legally authorized to prescribe such items by law.
(B) Diabetes outpatient self-management training and education shall be provided by a certified, registered, or licensed health care professional with expertise in diabetes.
(C)(1) The benefits provided in this section are subject to the same annual deductibles or co-insurance established for all other covered benefits within a given policy or contract.
(2) Private third-party payors may not reduce or eliminate coverage due to the requirements of this section.
(3) The Chief Insurance Commissioner shall promulgate necessary regulations to enforce the provisions of this section."
SECTION 2. This act takes effect upon approval by the Governor.
