TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-1630 SO AS TO PROVIDE THAT THE DEPARTMENT OF PUBLIC SAFETY SHALL OFFER FOR SALE COUPONS THAT ALLOW A PERSON STOPPED FOR SPEEDING UNDER CERTAIN CIRCUMSTANCES TO PRESENT TO A LAW ENFORCEMENT OFFICER IN LIEU OF RECEIVING A SPEEDING TICKET AND TO PROVIDE FOR THE DISTRIBUTION OF MONEY COLLECTED FROM THE SALE OF THE COUPONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 56-5-1630. (A) Notwithstanding another provision of law, the Department of Public Safety shall offer for sale to the public in each county coupons that allow a person stopped by a law enforcement officer for driving at a speed not more than ten miles an hour in excess of the posted speed limit to present to the officer. Upon presentment of a coupon to the officer, the officer shall release the person from custody immediately and shall not issue a ticket charging him with an offense.
(B) The price of a coupon book is one hundred dollars and shall contain four coupons each with a value of twenty-five dollars. A coupon is valid for one year.
(C) Money collected from the sale of coupon books must be deposited in the state's general fund with:
(1) forty percent distributed to each county treasurer's office proportionately based upon the county's population; and
(2) sixty percent distributed to the South Carolina Transportation Infrastructure Bank."
SECTION 2. This act takes effect upon approval by the Governor.
