TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-3-495 SO AS TO PROVIDE THAT A SEX OFFENDER MUST TENDER HIS DRIVER'S LICENSE TO A SENTENCING COURT AND BE ISSUED A DRIVER'S LICENSE WITH A "Y" RESTRICTION BY THE DEPARTMENT OF PUBLIC SAFETY FOR A FEE, THAT THE RESTRICTION MUST BE REMOVED ONCE THE OFFENDER IS REMOVED FROM THE REGISTRY, AND THAT THE SENTENCING COURT SHALL FORWARD TO THE DEPARTMENT OF PUBLIC SAFETY ALL DRIVERS' LICENSES IT RECEIVES WITH A COPY OF EACH SENTENCING ORDER.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 23-3-495. (A) A person required to register as a sex offender shall tender his driver's license to the sentencing court which shall issue him a temporary driver's license that directs him to report to the Department of Public Safety and obtain a replacement driver's license with a 'Y' restriction printed on its face. This restriction indicates that he is a sex offender. The sex offender shall tender five dollars for the replacement driver's license.
(B) Once a person is removed from the sex offender registry, the Department of Public Safety shall issue him a driver's license at no charge without the 'Y' restriction printed on it.
(C) The sentencing court shall forward to the Department of Public Safety all drivers' licenses it receives pursuant to this section with a copy of each Sentencing Order."
SECTION 2. This act takes effect upon approval by the Governor.
