A BILL

TO AMEND CHAPTER 1, TITLE 8, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-1-200, SO AS TO PROVIDE THAT AN APPOINTED PUBLIC OFFICIAL WHOSE TERM OF OFFICE HAS EXPIRED WHO HAS NOT BEEN REAPPOINTED, AND FOR WHOM A SUCCESSOR HAS NOT BEEN APPOINTED, MAY NOT CONTINUE TO SERVE IN THAT OFFICE IN A HOLDOVER CAPACITY FOR A PERIOD IN EXCESS OF ONE YEAR.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 1, Title 8 of the 1976 Code is amended by adding:

"Section 8-1-200. An appointed public official whose term of office has expired who has not been reappointed, and for whom a successor has not been appointed, may not continue to serve in that office in a holdover capacity for a period in excess of one year. After a period of one year has expired without reappointment of the current officeholder and without a successor being appointed, the office is considered vacant until a reappointment or an appointment to that office is made."

SECTION 2. This act takes effect upon approval by the Governor.
