Listed below are the Acts from the 1998 Legislative Session. Following each Act number are the Ratification number (preceded by an R), the bill number (preceded by an H for House or an S for Senate), a brief description and the date the Act became effective. An Act will not be added to this page until it has been assigned an Act Number. The full text of an Act is included in the linked page.
--Income tax, reference date updated whereby state adopts Internal Revenue Code of 1986;
Taxation. Effective February 20, 1998, for taxable years beginning after 1996
-- Head lice (pediculosis), school district students,
treatment; Health and Environmental Control Department. See Act for explanation of effective
date.
-- Taxation, Property, Real estate; Deed recording fee, certain exempt in lieu of foreclosure.
Effective June 9, 1998, and applies with respect to deeds recorded on or after this date.
-- Health Benefits and Education Act, Medical, Insurance, mastectomy, mammograms, pap
smears, breast surgery, cancer. Effective June 8, 1998, and applies to all individual and group
health insurance and health maintenance organization policies, as the case may be, issued,
delivered, issued for delivery, or renewed in this State on or after January 1, 1999.
-- Dissolved corporation, former shareholder of; claimant suit and judgment against;
Businesses and Corporations. Effective June 9, 1998, and applies to corporations dissolved
before, on, or after the effective date.
-- Admissions license tax, imposition of and exemptions from, Taxation; Gambling, Bingo
license tax, hard cards, Revenue. Effective June 9, 1998, with the exception of Section 1 which
takes effect January 1, 1999.
-- Mortgage loan brokers, continuing education requirements; Consumer Affairs, Banks and
Savings and Loan Associations. Effective June 9, 1998 for Section 11, the remaining provisions
take effect October 1, 1998.
-- Property tax assessments, proration of between transferor and transferee on items titled
by state, federal agency. Effective January 1, 1998, and applies with respect to transfers
occurring after 1997.
-- Deer, exotic farm-raised; sale of in food establishments allowed; Businesses, Agriculture;
Fish and Game. Signed by the Governor June 8, 1998, this act takes effect May 1, 1998.
-- General sessions Courts, surcharges imposed; Crimes and Offenses, victims, impact
statement, post-conviction, notify. Effective June 8, 1998, except as otherwise provided; see Act
for exceptions.
-- Income tax credits, investment in film enterprise, motion picture production facility;
Taxation, Movies. Effective June 9, 1998; see Act for exceptions.
-- Alcohol and Alcoholic Beverages, beer and wine, minibottles, retail licenses; protests,
hearings, permanent license. Effective August 1, 1998, and applies with respect to applications
for beer and wine permits and minibottle licenses filed on or after that date.
-- Genetic information, privacy of regarding health insurance, Medical. Effective 180 days
after approval by the Governor--Governor signed May 26, 1998
-- Taxation, Revenue Department, extension of time to pay taxes due innocent or corporate
taxpayer, Property, Income tax. Effective June 15, 1998, and is effective for tax years beginning
after December 31, 1997.
-- Income tax withholding, nonresident beneficiary; Taxation, Trusts and Estates,
Gambling, Bingo, licensees, hard cards. Effective June 15, 1998, except Section 3, which takes
effect October 1, 1998.
-- Income tax credit, retirement plan contributions made by taxpayer living in another state,
Taxation, Retirement Systems. Effective June 9, 1998 for taxable years beginning after 1996.
-- Public safety communication, Commercial Mobile Radio Service (CMRS) 911
established, Emergency Telephone Service. Effective June 11, 1998, with the committee
commencing operations on August 1, 1998, and CMRS collection of surcharges commencing on
November 1, 1998.
-- Assistive Technology Warranty Act, Consumer Affairs, Warranties; Handicapped,
Medical, Aging. Effective June 8, 1998, and applies only to assistive technology devices sold or
leased after January 1, 1999.
-- Legislative Incentives for Future Excellence (LIFE) Scholarships, Colleges and
Universities, Income tax credit, tuition. Effective June 19, 1998, provided, however, the
provisions of Section 2 are effective for taxable years beginning after 1997 and applies only for
persons graduating from high school during or after May, 1997.
-- Military Facilities Redevelopment Law, dispose of federal installations, defense sites;
Property; Veterans' Affairs. Effective June 9, 1998; see Act for exceptions.
-- DUI, Transportation, Traffic violations, Motor Vehicles, Drivers license suspension,
chemical test, Alcohol, videotaping. Effective June 29, 1998; see Act for exceptions.
-- Retirement Systems, military and national guard service credit; Adjutant General,
Veterans' Affairs, Pensions. Effective June 16, 1998, and applies with respect to military
service established in the state retirement systems on or after this date.
-- Patients' Insurance and Benefits Protection Act, Medical, medical and health. Effective
January 1, 1999, except that the provisions of the act applicable to employer-sponsored health
plans are effective for plan years beginning on or after January 1, 1999.
-- Capital Reserve Fund, Acts Cited By Popular Name, Appropriation Acts. Effective thirty
days after the completion of the 1997-98 fiscal year in accordance with the provisions of Article
III, Section 36(B)(3)(a), Constitution of South Carolina, 1895, and Section 11-11-320(D)(1) of
the 1976 Code.
-- Clarendon County Vocational Educational School Advisory Board, School districts;
county council governing body of. Effective June 11, 1998; see Act for explanation.
-- Lee County Education Board, election of chairman and vice chairman; Schools and
School Districts. Effective June 11, 1998, and is applied retroactively so as to ratify elections of
chairmen and vice chairmen at January meetings in the past.
