Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

Help us, Lord, to make each step of such a quality as to prepare us for the next step. We know that failure can be caused by those who were qualified but never acted or by those who acted and were not qualified. Make of us worthy examples for those around us. Impress upon us, then, that the way we teach is important, what we teach is more important, but how we live is most important.

Make us resolute, therefore, to teach and to live under the guidance of Your Holy Word. Amen.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER.

After corrections to the Journal of the proceedings of yesterday, the SPEAKER ordered it confirmed.

MOTION ADOPTED

STATEMENT FOR JOURNAL

I co-sponsored and supported Amendment #8 regarding the purchase of desks, chairs and laptop computer options for the S.C. House. Similarily, I proposed an amendment two years ago to delay the expenditure of $50 million dollars until other more high-priority needs were met. At the time, our credit rating had been reduced and was in jeopardy. High quality, yet reasonably-priced desks and chairs are necessary in the newly-renovated State House. Necessary not for the present members, but for the State. However, I strongly oppose an expenditure at this time for new desks, chairs and certainly laptop computers. We have more pressing needs today just as we did when we obligated ourselves to the $50 million to renovate the State House. I applaud the work done and time spent by the State House committee and the Speaker on this issue. However, my actions today are consistent with my past actions which I feel are in the best interests of our State at this time.

POINT OF ORDER

Rep. SHEHEEN raised a Point of Order that Section 3 was not germane to the Bill in that the Bill pertains to supplemental appropriations for 1996-1997 and ends on June 30, 1997, but the Section 3 takes effect January 1, 1998 after the Bill expires. He stated that the supplemental bill cannot effect permanent law after June 30, 1997.

SPEAKER WILKINS stated that Section 2 pertains to supplemental appropriations for 1997-1998 as well.

Rep. ROBINSON argued contra in that the permanent law of the Bill would be effective January 1, 1998.

Rep. SHEHEEN stated that a change in the permanent law would be improper.

SPEAKER WILKINS stated that the monies appropriated would be available for use in August of 1997, would be actually spent in fiscal year 1997-98, and therefore Section 3 was effective within the year referenced in the Bill. The SPEAKER also stated that in accordance with Rule 5.3 which refers to germaneness on supplemental appropriations bills, no provisions shall be put in a permanent part of any such bill unless it relates directly to a purpose of an appropriation made or revenue provided therein for the fiscal year referred to in the Bill. He further stated that the provisions of this paragraph shall be narrowly and strictly construed with regard to all provisions and amendments to the General Appropriations Bill and Supplemental Appropriations Bills. He further stated that based on the House Rules there was no prohibition to putting a permanent section in the supplemental appropriations bill. He therefore overruled the Point Of Order.

Whereas, for twenty-one years Mary Freeman Elam has served the General Assembly, as well as the members of the public and all of state government, most devotedly through her work at Legislative Information Systems (LIS); and

Whereas, the members of the General Assembly quickly grew to admire her for her intelligence, efficiency, hard work, and dedication; she also possesses a truly kind and sweet personality -- a fact which has endeared her to all who have known her; and

Whereas, she is leaving her position at LIS effective March 6, 1997; this comes as a blow to the members because her unique quality and style of service and assistance will be greatly missed; and

Whereas, we want Mary to know that she has made our job much easier, that all of her efforts are greatly appreciated, and that we will always hold her in the highest esteem. Now, therefore,

Be it resolved by the House of Representatives:

That the members of the House of Representatives of the State of South Carolina, by this resolution, recognize and commend Mary Freeman Elam of Legislative Information Systems for exemplary service to the General Assembly and wish her happiness and success in her future endeavors.

Be it further resolved that a copy of this resolution be forwarded to Mary Freeman Elam.

The Resolution was adopted.
