The House assembled at 10:00 A.M.

Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

O God our Father, our Help for every new day and our Hope for every unknown tomorrow, look with Your favor upon us that we may experience Your ever-abiding presence. We thank You for homes to share, for families to love, for friends to cherish, for places of service to fill, and for work to do. Forbid that we should walk through this world with unseeing eyes or grateful hearts. As the springtime progresses, bringing with it the beautiful array of flowers and the chorus of the birds, God forbid that we should possess an unresponsive attitude.

Thank You, Lord, for this privilege of prayer. Amen.

Seithel and Haskins: A BILL TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 61-6-35 SO AS TO PROHIBIT DRINKING GAMES IN ESTABLISHMENTS WHICH SELL ALCOHOLIC LIQUORS FOR CONSUMPTION ON THE PREMISES, TO PROVIDE PENALTIES, AND TO DEFINE "DRINKING GAMES" AND "ALCOHOLIC LIQUORS".

The Committee on Judiciary proposed the following Amendment No. 1 (Doc Name P:\AMEND\PSD\7181AC.97).

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/ Section     1.     The 1976 Code is amended by adding:

"Section     61-6-2230.     (A)     No person licensed to sell alcoholic beverages pursuant to this article may knowingly conduct, operate, organize, promote, advertise, run, or participate in a 'drinking contest' or 'drinking game'.

(B)     For purposes of this section, 'drinking contest' or 'drinking game' includes, but is not limited to, a contest, game, event, or other endeavor which encourages or promotes the consumption of alcoholic beverages by participants at extraordinary speed or in increased quantities or in more potent form. 'drinking contest' or 'drinking game' does not include a contest, game, event, or endeavor in which alcoholic beverages are not used or consumed by participants as part of the contest, game, event, or endeavor but instead are used solely as a reward or prize. Selling alcoholic beverages in the regular course of business is not considered a violation of this section."

SECTION     2.     Section 61-4-580(6) of the 1976 Code is added by Act 415 of 1997, is amended to read:

"(6)     sell, offer for sale, or possess any beverage or alcoholic liquors the sale or possession of which is prohibited on the licensed premises under the law of this State.; or

(7)     conduct, operate, organize, promote, advertise, run, or participate in a 'drinking contest' or 'drinking game'. For purposes of this item, 'drinking contest' or 'drinking game' includes, but is not limited to, a contest, game, event, or other endeavor which encourages or promotes the consumption of beer or wine by participants at extraordinary speed or in increased quantities or in more potent form. 'Drinking contest' or 'drinking game' does not include a contest, game, event, or endeavor in which beer or wine is not used or consumed by participants as part of the contest, game, event, or endeavor, but instead is used solely as a reward or prize. Selling beer or wine in the regular course of business is not considered a violation of this section."

SECTION     3.     This act takes effect upon approval by the Governor./

In all such civil or criminal proceedings good faith is rebuttably presumed. This grant of immunity is cumulative to and does not replace any other immunity provided under the South Carolina Tort Claims Act."/

Whereas, veterans of the United States armed services and the veterans' survivors and their families who reside in the Midlands area of South Carolina in and around the capital city of Columbia, as well as in western and northern South Carolina, presently must use the national cemeteries in Florence or Beaufort--cities which are considerable distances from their homes; travel to these cemeteries places an undue burden on these deserving citizens; and

Whereas, the need exists for the location of a national cemetery in the Columbia, South Carolina area where Fort Jackson is situated; and

Whereas, sufficient unused land exists on the Fort Jackson installation for use as a national cemetery, and such a cemetery should be established on this military base at the earliest possible time. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the General Assembly of the State of South Carolina, by this resolution, memorializes Congress to take the necessary steps to provide for a national cemetery to be located at Fort Jackson in the State of South Carolina.

Whereas, the Honorable Marshall Burns Williams was born on January 17, 1912 in Norway, South Carolina; and

Whereas, he was the son of C. H. and Maude Williams of Orangeburg, South Carolina; and

Whereas, Senator Williams earned a B.S. degree from the University of South Carolina in 1933, an LL.B. degree from the University of South Carolina in 1936, had a J.D. degree conferred by the University of South Carolina in 1970, and received an Honorary Doctorate of Laws degree from South Carolina State University in 1989; and

Whereas, he married Margaret Shecut in 1942 and together reared four children; and

Whereas, among the many outstanding achievements Senator Williams accomplished during his lifetime, were his service as President of the South Carolina Young Democrats Club, a Fellow of the American College of Trial Lawyers, and a member of the American and South Carolina Bar Associations; and

Whereas, he was a World War II veteran, having served in the United States Naval Air Corps from 1942 to 1946 and having attained the rank of Lieutenant Commander; and

Whereas, he served in the South Carolina House of Representatives from 1947 to 1952; and

Whereas, he served in the South Carolina Senate from 1953 until his death on December 28, 1995; and

Whereas, during his distinguished career in the South Carolina Senate, Senator Williams served as Chairman of the Senate Medical Affairs Committee, Chairman of the Senate Banking and Insurance Committee, and Chairman of the Senate Judiciary Committee; and

Whereas, Senator Williams served as President Pro Tempore of the Senate from January 10, 1989 until his death; and

Whereas, at the time of his death, he was the longest serving state senator in the United States; and

Whereas, it is fitting and proper that the portion of United States Highway 301 in Orangeburg County from Interstate Highway 26 continuing to the United States Highway 178 Bypass be named "Marshall B. Williams Boulevard" as a lasting tribute to this distinguished South Carolinian. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the members of the General Assembly request that the Department of Transportation designate and name the portion of United States Highway 301 in Orangeburg County for the late Marshall B. Williams described in this resolution the "Marshall B. Williams Boulevard" and install appropriate markers or signs at places along the highway as the department considers advisable containing the words "Marshall B. Williams Boulevard".

Be it further resolved that a copy of this resolution be forwarded to the Department of Transportation and the family of the Honorable Marshall B. Williams.

The Concurrent Resolution was adopted and ordered sent to the Senate.
