The Senate assembled at 11:00 A.M., the hour to which it stood adjourned, and was called to order by the ACTING PRESIDENT, Senator WILSON.

H. 5183 (Word version) -- Rep. Cave: A BILL TO PROVIDE FOR FOUR ADDITIONAL MEMBERS OF THE ALLENDALE COUNTY BOARD OF EDUCATION TO SERVE FOR TERMS TO EXPIRE IN 2002, TO PROVIDE FOR THE MANNER IN WHICH THESE ADDITIONAL MEMBERS SHALL BE APPOINTED, AND TO PROVIDE THAT THEIR SUCCESSORS SHALL BE ELECTED AT THE 2002 ELECTION IN THE MANNER THE GENERAL ASSEMBLY SHALL PROVIDE BY LAW.

The Senate proceeded to a consideration of the Bill, the question being the third reading of the Bill.

Senators WASHINGTON and HUTTO proposed the following amendment (GJK\21625SD.98), which was adopted:
Amend the bill, as and if amended, by striking SECTION 1 and inserting:
/SECTION   1.   Notwithstanding any other provision of law:
(1)   There shall be two additional members of the Allendale County Board of Education to be appointed from the county at large by the Governor upon the recommendation of the Allendale County Legislative Delegation for terms to commence on July 1, 1998, and to expire when their successors elected at the 2000 election, as hereinafter provided, take office. Each of these two members shall serve until their successors are selected and qualify. The General Assembly by law shall provide for the manner in which successors to these two members shall be elected beginning with the 2000 election.
(2)   If a vacancy occurs on the board for any reason, other than expiration of a term, nine months or more before the scheduled expiration of the term of the member giving rise to the vacancy, it shall be filled for the remainder of the unexpired term by special election to be conducted by the Allendale County Registration and Elections Commission in the same manner regular school elections are conducted, mutatis mutandis. The Allendale County Registration and Elections Commission shall set the date of the elections, conduct the elections in accordance with applicable law, and declare and certify the results.
(3)   If a vacancy occurs on the board for any reason, other than expiration of a term, less than nine months before the scheduled expiration of the term of the member giving rise to the vacancy, it shall be filled for the remainder of the unexpired term by appointment of the Governor upon the recommendation of the Allendale County Legislative Delegation./

There being no further amendments, the Bill was read the third time and ordered returned to the House of Representatives with amendments.
