A BILL

TO AMEND CHAPTER 101, TITLE 59, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO COLLEGES AND INSTITUTIONS OF HIGHER LEARNING, BY ADDING SECTION 59-101-380 SO AS TO REQUIRE EACH FOUR-YEAR PUBLIC COLLEGE OR UNIVERSITY TO ANNUALLY PROVIDE TO THE GENERAL ASSEMBLY A WRITTEN REPORT REGARDING LAWSUITS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 101, Title 59 of the 1976 Code is amended by adding:

"Section 59-101-380. Not later than September first of each year, each four-year public college or university shall provide to the General Assembly a written report setting forth, for the previous fiscal year:

(1) the number of lawsuits pending at the beginning of the fiscal year, the case name of each pending lawsuit, and a description of the cause of action for each lawsuit named;

(2) the number of lawsuits filed during the fiscal year involving the school, the case name of each lawsuit, and a description of the cause of action for each lawsuit named;

(3) the number of lawsuits that were settled during the fiscal year, the case name of each lawsuit settled, a description of the cause of action for each lawsuit settled, and the amount of the settlement for each lawsuit settled;

(4) the number of lawsuits that were resolved by court verdict during the fiscal year, the case name of each lawsuit resolved by court verdict, a description of the court verdict for each lawsuit resolved, and the amount of the court verdict, if any, for each lawsuit resolved;

(5) the number of lawsuits that were disposed of without a court verdict or settlement during the fiscal year, the case name of each lawsuit that was disposed of without a court verdict or settlement, and a description of the action that resolved the lawsuit;

(6) the number of jury verdicts and other dispositions appealed during the fiscal year by any party to the lawsuit, the name of each lawsuit in which an appeal was filed, and a description of the issues raised on appeal; and

(7) the number of lawsuits pending at the close of the fiscal year, the case name of each pending lawsuit, and a description of the cause of action for each lawsuit named."

SECTION 2. This act takes effect upon approval by the Governor.
