TO AMEND SECTION 56-10-553, RELATING TO THE COLLECTION OF DATA BY THE DEPARTMENT OF PUBLIC SAFETY REGARDING MOTOR VEHICLE REGISTRATION AND INSURANCE, SO AS TO INCREASE THE TIME PERIOD WITHIN WHICH RANDOM INSURANCE SURVEY FORMS MUST BE RETURNED FROM FIFTEEN DAYS AFTER RECEIPT TO THIRTY DAYS AFTER RECEIPT; AND TO PROVIDE THAT IF A PERSON PROVIDES PROOF OF INSURANCE WITHIN SEVEN DAYS OF THE SUSPENSION OF VEHICLE REGISTRATION FOR FAILURE TO RETURN THE FORM, THE FEE FOR REINSTATING THE REGISTRATION SHALL NOT BE REQUIRED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-10-553(C) of the 1976 Code is amended to read:
"(C) The Department of Public Safety must on a daily basis select a computerized random sample of five hundred of the registered vehicles in the State and mail to each owner a written request form to be completed by him and his insurance company or the agent issuing the policy to verify liability insurance coverage. The form must be in a manner prescribed by regulation of the department. The completed and verified form must be returned by the owner to the department within fifteen thirty days from the date he receives it. Failure to return the form verified in the proper manner is prima facie evidence that the vehicle is uninsured, and vehicles determined to be uninsured under this section are subject to the provisions of state law dealing with uninsured vehicles. However, a person who provides proof that the motor vehicle is insured to the department within seven days of the suspension of vehicle registration because of failure to return the form shall not be required to pay the reinstatement fee required by law."
SECTION 2. This act takes effect upon approval by the Governor.
