TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-67-105 SO AS TO PROVIDE THAT ALL REPLACEMENT OR NEW SCHOOL BUSES BE EQUIPPED WITH APPROVED SAFETY BELTS AND TO PROVIDE A PERIOD OF TIME FOR ALL SCHOOL BUSES TO BE EQUIPPED WITH APPROVED SAFETY BELTS; AND TO AMEND SECTION 56-5-6530, RELATING TO EXCEPTIONS FOR MANDATORY USE OF SEAT BELTS, SO AS TO DELETE THE EXCEPTION FOR SCHOOL BUSES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-67-105. (A) Every school bus must be equipped with safety belts for use by each person riding the bus in the manner required by this section. A new or replacement bus must be equipped with approved safety belts before it is placed into service.
(B) Buses currently in service for the transportation of elementary or middle school pupils must be equipped with approved safety belts within three years of the effective date of this section. All other school buses currently in service must comply with the provisions of this section within five years of the effective date of this section.
(C) The State Department of Education shall promulgate regulations on the type and specification of safety belts to be installed on school buses.
(D) Notwithstanding another provision of law, the driver of a school bus equipped with safety belts must load his passengers from the rear to the front of the bus and ensure that each passenger uses his safety belt."
SECTION 2. Item (3) of Section 56-5-6530 of the 1976 Code is amended to read:
"(3) school, church, or day care buses;"
SECTION 3. This act takes effect upon approval by the Governor.
