TO AMEND SECTION 50-11-10, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA 1976, RELATING TO HUNTING MIGRATORY BIRDS, SO AS TO PROHIBIT TRESPASSING WHILE HUNTING WATERFOWL, TAKING WATERFOWL OVER BAIT, TAKING MORE THAN ONE WATERFOWL OVER THE LEGAL LIMIT, HUNTING WATERFOWL OUT OF SEASON, AND HUNTING WATERFOWL BEFORE OR AFTER DESIGNATED SHOOTING HOURS, AND TO PROVIDE PENALTIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 50-11-10(B) of the 1976 Code, as amended by Act 301 of 1992, is further amended to read:
"(B) If a A person is convicted of one or more any of the following offenses, he must be fined not less than two hundred dollars nor more than five hundred dollars or imprisoned not more than ninety thirty days for each offense:
(1) trespassing to hunt while hunting waterfowl;
(2) hunting or taking waterfowl over bait;
(3) shooting waterfowl over bait taking or possessing more than one waterfowl over the legal limit;
(4) hunting waterfowl more than fifteen minutes before or after regularly designated hunting hours out of season;
(5) possessing more than one waterfowl over the legal limit; hunting waterfowl before or after designated shooting hours.
(6) hunting waterfowl out of season.
In addition to any criminal penalty a person convicted of items 1-4 must lose all hunting and fishing privileges for one year. A person convicted of item 5 must lose all hunting and fishing privileges for one year when the violation is more than five minutes before or after designated shooting hours."
SECTION 2. This act takes effect upon approval by the Governor and applies only to offenses occurring on or after the effective date. Cases and appeals arising or pending under Section 50-11-10 prior to the effective date of this act are saved.
