A BILL

TO AMEND SECTION 42-1-380, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO AN EMPLOYER'S WAIVER OF THE EXEMPTION FROM THE MANDATORY PROVISIONS OF TITLE 42, THE SOUTH CAROLINA WORKERS' COMPENSATION LAW, SO AS TO PERMIT COMING IN UNDER TITLE 42 BY PURCHASING WORKERS' COMPENSATION INSURANCE OR BY OPERATING UNDER AN APPROVED SELF-INSURANCE PROGRAM.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 42-1-380 of the 1976 Code is amended to read:

"Section 42-1-380. Any person employing employees in the State and exempted from the mandatory provisions of this title may come in under the terms of this title and receive the benefits and be subject to the liabilities of this title by filing with the Commission a written notice of his desire to be subject to the terms and provisions of this Title. Any such person shall come under the provisions of this Title and be affected thereby thirty days after the date of such notice. purchasing workers' compensation insurance or by operating under an approved self-insurance program."

SECTION 2. This act takes effect upon approval by the Governor.
