TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-17-115 SO AS TO PROVIDE THAT ALL PERSONS APPLYING FOR EMPLOYMENT IN ANY CAPACITY WITHIN ANY PUBLIC SCHOOL OR PUBLIC SCHOOL DISTRICT SHALL BE REQUIRED TO SUBMIT FINGERPRINTS FOR THE PURPOSE OF A BACKGROUND INVESTIGATION AND A CRIMINAL HISTORY CHECK.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-17-115. All persons applying for employment in any capacity within any public school or public school district shall be required to submit fingerprints for the purpose of a background investigation and a criminal history check.
The fingerprints and other required data shall be submitted to the State Law Enforcement Division to determine any state criminal history and to the Federal Bureau of Investigation to determine any other criminal history. The names of all perspective applicants also must be checked against the Sex Offender Registry maintained by SLED and any lists maintained by the Department of Social Services, and the National Center for Missing and Exploited Children of those who have abused, neglected, or otherwise exploited children.
Any information obtained pursuant to this section may be utilized to determine the applicant's eligibility for employment. Any fees charged by SLED, the FBI, DSS, and the NCMEC shall be paid by the applicant.
School officials in regard to certified education personnel for purposes of compliance with the provisions of this section may utilize the fingerprint review conducted under Section 59-25-115 if it was conducted within three years of the date of the employment application."
SECTION 2. This act takes effect upon approval by the Governor.
