TO REQUIRE THE DEPARTMENT OF PUBLIC SAFETY TO MAIL A FORM TO EACH LICENSED DRIVER PROVIDING INFORMATION ON THE CURRENT LAW AUTHORIZING THE DEPARTMENT TO SELL DRIVERS' PHOTOGRAPHIC OR DIGITIZED IMAGES FROM THEIR DRIVERS' LICENSE RECORDS AND GIVING EACH DRIVER THE OPTION TO PERMIT OR REFUSE TO HAVE THE DRIVER'S IMAGE SOLD OR DISTRIBUTED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The Department of Public Safety shall mail a notice and optout form to each licensed driver in this State providing information on the current law authorizing the department to sell a driver's photographic or digitized images from their license records and giving each driver the option to permit or refuse to have the driver's image or likeness sold or distributed. If the driver does not return the form, the department may sell or distribute the driver's photographic or digitized image. However, if the driver returns the form and does not give permission, the department may not release the driver's photographic or digitized image for any commercial purpose.
SECTION 2. The Department of Public Safety shall mail to all licensed drivers in the State the forms required by Section 1 of this joint resolution within ninety days of this joint resolution's effective date.
SECTION 3. This joint resolution takes effect upon approval by the Governor.
