TO AMEND ARTICLE 1, CHAPTER 43 OF TITLE 38, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PROVISIONS OF LAW GOVERNING THE LICENSING AND REGULATION OF INSURANCE AGENTS, BY ADDING SECTION 38-43-25 SO AS TO PROVIDE THAT A MOTOR VEHICLE RENTAL COMPANY AND ITS AGENTS OR EMPLOYEES MAY, INCIDENTAL TO A RENTAL TRANSACTION, SELL AND COLLECT PREMIUMS FOR OPTIONAL TRAVEL OR MOTOR VEHICLE-RELATED INSURANCE COVERAGES WITHOUT BEING DEEMED "INSURANCE AGENTS", AND PROVIDE THAT THE AGENTS AND EMPLOYEES OF SUCH COMPANY ARE EXEMPT FROM ALL PROVISIONS OF LAW APPLICABLE TO INSURANCE AGENTS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 43 of Title 38 of the 1976 Code is amended by adding:
"Section 38-43-25. A motor vehicle rental company and its agents or employees may, incidental to a rental transaction, sell and collect premiums for optional travel or motor vehicle-related insurance coverages applicable to a motor vehicle being rented to a consumer by the company, and the company and its agents or employees shall not be deemed insurance agents within the meaning of this chapter and are exempt from all the provisions of this chapter, including specifically, but not limited to, continuing education requirements for insurance agents in Section 38-43-106, as well as any other provisions of law applicable to insurance agents."
SECTION 2. This act takes effect upon approval by the Governor.
