A BILL

TO AMEND CHAPTER 19, TITLE 50 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO RESTRICTIONS ON FISHING LAKES MARION AND MOULTRIE, BY ADDING SECTION 50-19-1921, SO AS TO RESTRICT TO ONE THE NUMBER OF BLUE CATFISH AND FLATHEAD CATFISH 40 INCHES OR LARGER THAT MAY BE TAKEN FROM LAKES MARION AND MOULTRIE, AND THE WATERS BETWEEN THE CONFLUENCE OF WATEREE AND CONGAREE RIVERS, AND THE BACKWATERS OF LAKE MARION WHICH IS CONSIDERED A PART OF LAKE MOULTRIE; AND TO AMEND CHAPTER 13 OF TITLE 50, RELATING TO PROTECTION OF FISH, BY ADDING SECTION 50-13-1625, SO AS TO MAKE IT UNLAWFUL TO POSSESS OR CONTROL MORE THAN ONE LIVE BLUE OR FLATHEAD CATFISH 40 INCHES OR LARGER AND TO EXEMPT AQUACULTURE CONCERNS POSSESSING BROODSTOCK IF THEY HAVE A HISTORY OF FISH PROPAGATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 19, Title 50 of the 1976 Code is amended by adding:

"Section 50-13-1921. It shall be unlawful to take more than one blue catfish (Ictalurus furcatus) or one flathead catfish (Pylodictis olivaris) 40 inches or larger from Lakes Marion and Moultrie, the waters lying between the confluence of the Wateree and Congaree Rivers, and the backwaters of Lake Marion and considered a part of Lake Moultrie."

SECTION 2. Chapter 13, Title 50 of the 1976 Code is amended by adding:

"Section 50-13-1625. It shall be unlawful for any person to have in his immediate possession or control more than one live blue catfish (Ictalurus furcatus) or one live flathead catfish (Pylodictis olivaris) 40 inches or larger; provided, that the provisions of this section do not apply to broodstock possession by aquaculture concerns with a history of fish propagation."

SECTION 3. This act takes effect upon approval by the Governor.
