The Senate assembled at 11:00 A.M., the hour to which it stood adjourned, and was called to order by the PRESIDENT.

A quorum being present, the proceedings were opened with a devotion by the Chaplain as follows:

Beloved, hear the words of the Prophet Isaiah, Chapter 30: 15-21:

Remarks by Senator PASSAILAIGUE

Thank you, Mr. PRESIDENT.

Ladies and gentlemen, I rise today to recognize one of our colleagues, Senator WASHINGTON, who was elected to the Employment Security Commission yesterday. I have mixed feelings in this regard. I probably speak from, I guess ninety-nine and nine-tenths percent of everybody in here.

We all have, I think, mixed feelings regarding the Senator from Charleston, Senator WASHINGTON, getting a majority vote in that election and we wish him well. But, I think that if you look at people that are hard to replace on the floor of the South Carolina Senate, not to mention in local politics and state politics and national politics, one is Senator McKINLEY WASHINGTON. If there ever was a bridge-builder in South Carolina, it's Senator WASHINGTON.

I just remember when I first was thinking about running for office back around 1987, Senator WASHINGTON didn't know me from Adam's housecat, and I must have made some kind of impression on him because he decided to support me. I wanted to say that was pretty courageous of him because actually I was running against a very fine black lady he knew and he knew well. He still decided to support my candidacy. It's something I'll never forget. That trust, I hope, has been paid back, Senator WASHINGTON. I just think, on behalf of the entire Senate, we just want to say to you how much you really mean to this body and how much you've meant to this body and the Legislature and the State of South Carolina.

We're going to miss you in the legislative process, but we certainly look forward to your many years of service in the Employment Security Commission.

Remarks by Senator J. VERNE SMITH

I have to brag on my Preacher a little bit, too. I never will forget, years ago McKINLEY WASHINGTON at the State Democratic Convention. We had a fellow named Sam Hunt from Greenville. He was a wonderful fellow. He'd been Treasurer of the S.C. Democratic Party for years and he was one of the few bankers that were a Democrat so we were proud of him. He wanted to be Chairman of the S.C. Democratic Party. He and my son had been to the National Democratic Convention several times and I wasn't even going to the state convention that year. But, he said, 'Verne, I want you to nominate me. If you'll just nominate me, I'll just be your friend. I'll swim the English Channel for you. ' I said, 'Well, I'll nominate you if you want me to that badly.'

They called on me. I got up there and, I believe, I made the best nominating speech I ever made in my life. And, I've made some plum good ones. Those people were just clapping and swaying, and I was wiping my head and I was saying 'Amen.' I just thought I had it locked down.

Then, they called on Preacher McKinley Washington to nominate the next fellow. I'm telling you if he didn't outdo me. It was just like a little boy and a man sent on the same job. He had those people standing up and clapping and saying, 'Right on, brother, right on. Amen. Right on!'

He beat me about three or two to one at least. I said, 'Now, that's a fellow who bears watching.' I'll tell you I've had my eye on him ever since.

We are going to miss you, Preacher. I know you'll do a good job where you're going. It has been a great honor to serve with you and you are a plum nice fellow. Sometimes, you aren't good enough for them foot-of-the-mountain boys, but I know where you live and for two hundred years y'all have been carrying money towards the seashore. But, now that you are in a statewide position, you've got to think a little more of those foot-of-the-mountain boys. Give them a good fair shake. Don't keep all the money going down to Charleston; kind of spread it out a little and let us have a child's part.

Remarks by Senator SETZLER

Mr. PRESIDENT, ladies and gentlemen of the Senate.

Senator from Beaufort, Senator WASHINGTON, I wasn't going to say anything until later in the session when the Senator from Colleton leave us.

I can't let this opportunity go by without saying something. I may be wrong, but, I believe, I worked as closely or closer with the Senator from Colleton than any member of this body. I can tell you of his service on the Education Committee and especially on the Senate subcommittee on education that I chair. I don't know of a gentleman who has served in this body who has been more dedicated to the people of South Carolina and to the young children of South Carolina in educating all children of South Carolina, Senator, than you have.

Anytime we have had a difficult issue in the Education Committee and, you've picked on me many times about calling on you, you've been there. When we've had meetings, it may not have been on legislative days, but Senator WASHINGTON is here. He does his job and has done his job, not only for his constituents but for every South Carolinian. This body will miss Senator WASHINGTON. There are many giants who have served in this body, Senator. There is none who is any bigger than you are and we thank you for what you've done.

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/ SECTION   1.   Section 5-37-20(2) of the 1976 Code, as last amended by Act 118 of 1999, is further amended to read:

"(2)   'Improvements' include open or covered malls, parkways, parks and playgrounds, recreation facilities, athletic facilities, pedestrian facilities, parking facilities, parking garages, and underground parking facilities, and facade redevelopment, the widening and dredging of existing channels, canals, and waterways used specifically for recreational or other purposes, the relocation, construction, widening, and paving of streets, roads, and bridges, including demolition of them, underground utilities, all activities authorized by Chapter 1 of Title 31 (State Housing Law), any building or other facilities for public use, any public works eligible for financing under the provisions of Section 6-21-50, services or functions which a municipality in accordance with state law may by law provide, and all things incidental to the improvements, including planning, engineering, administration, managing, promotion, marketing, and acquisition of necessary easements and land, and may include facilities for lease or use by a private person, firm, or corporation. However, improvements as defined in this chapter must comply with all applicable state and federal laws and regulations governing these activities. Any such improvements may be designated by the governing body as public works eligible for revenue bond financing pursuant to Section 6-21-50, and such improvements, taken in the aggregate, may be designated by the governing body as a 'system' of related projects within the meaning of Section 6-21-40. The governing body of a municipality, after due investigation and study, may determine that improvements located outside the boundaries of an improvement district confer a benefit upon property inside an improvement district or are necessary to make improvements within the improvement district effective for the benefit of property inside the improvement district."

SECTION   2.   This act takes effect upon approval by the Governor. /
