Acts With Multiple Effective Dates
(These acts have multiple effective dates or other special circumstances. They are not listed below by effective date.)
-- Estate Tax Act, order in which federal estate tax credits applied provided; Trusts and Estates, Taxation. Effective April 22, 2002. This act takes effect upon approval by the Governor and applies to the calculation of South Carolina estate taxes due on or after that date.
-- Murder, death penalty for; statutory aggravating circumstance when county detention facility officer; Crimes, Execution. Effective May 1, 2002. This act takes effect upon approval by the Governor and applies to offenses committed on or after the effective date.
-- Insurance industry, various revisions. Effective May 1, 2002. Sections 1 through 8 and 10 through 15 of this act take effect upon approval by the Governor. Section 9 of this act takes effect ninety days after approval by the Governor.
-- Historic Rehabilitation Incentives Act, historic structures, income tax credit for; Buildings, Archives and History. Effective May 1, 2002. Upon approval by the Governor, this act is effective for taxable years beginning after 2002 for property placed in service after June 30, 2003.
-- Uniform Prudent Investor Act, investments in mutual funds. Effective May 1, 2002. This act takes effect upon approval by the Governor, and applies to affiliate investments and reinvestments made on or after July 18, 2001, the effective date of the South Carolina Uniform Prudent Investor Act.
-- Motor vehicle registration, grace period allowed for; temporary license plates provided; displaying of dealer sold cards. Effective January 1, 2003. See Act for exceptions.
-- Court fines, fees, assessments, and costs may be paid by credit or debit card; provisions regarding payment of money paid to magistrate or municipal judge in lieu of entering into recognizance. See Act for Effective Date
-- Homestead exemption, personal representative for estate of deceased taxpayer is deemed the agent for purposes of applying for. See Act for Effective Date
-- Funeral directors and embalmers, license and permit requirements; sale of funeral merchandise; to enact the Perpetual Care Cemetery Act; to repeal the Cemetery Act of 1984. Effective July 1, 2002. See Act for Exceptions
-- Motorist Insurance Identification Database Program Act; Motor Vehicle Division shall request proof of insurance from persons identified by Database. Effective July 1, 2002. See Act for Exceptions
-- Richland County School Districts Property Tax Relief Act, to provide for special one percent sales tax; election of trustees for Richland-Lexington School District 5; Richland-Lexington Airport District Commission, appointment of additional member; Midlands Technical College Commission, appointment of members. Effective June 18, 2002, except as otherwise provided for in the Act
-- Uniform court fee increases; domestic abuse, petitions for orders of protection, action may be brought in county in which alleged abuse occurred, criminal domestic violence arrest procedures. Effective June 18, 2002 and applies to orders of protection filed on or after the effective date
-- Residential Property Condition Act and Vacation Rental Act enacted; rental property, property tax assessment provisions and tenants' responsibility regarding utilities. Effective January 1, 2003, and applies to the covered residential transactions entered into on or after that date
-- Task Force to Review State and Federal Health Insurance Mandates established; new mandates restricted. Effective July 1, 2002. Section 38-71-285 of the 1976 Code, as added by this act, is repealed effective June 30, 2007.
-- Homeland Security Act. Effective July 2, 2002 and applies to offenses committed after its effective date and to causes of action arising or accruing on or after the effective date.
-- American Flag, no homeowners' association may restrict the display of. Effective July 3, 2002 and applies retroactively regardless of the date of adoption of any restrictive covenant, declaration, rule, contractual provision, or other requirement concerning flags or decorations found in a deed, contract, lease, rental agreement, or homeowners' association document.
-- Budget Proviso Codification Act. Effective July 1, 2002. See Act for Items Vetoed by the Governor and for Veto Sustained or Overridden by the General Assembly
-- Private Guardian Ad Litem Reform Act. Effective January 15, 2003, and applies to a guardian ad litem appointed in a custody case on or after the effective date.
-- Estimated Income Tax Payment Reform Act; deductions from taxable income for volunteer emergency workers including HAZMAT workers; discount for payment of sales tax for electronic filing. Effective August 2, 2002, and applies for taxable years beginning after 2002.
-- Poultry from flocks infected with avian flu, prohibitions. Effective May 20, 2002 and remains in effect only until permanent regulations relating to poultry import restrictions have been promulgated and become effective.
-- Laurens County Registration and Election Commission, terms of members staggered. Effective March 28, 2002 and applies to the appointment of members of the Registration and Elections Commission for Laurens County after the effective date of this act.
-- Union County School District Trustees, reapportionment of election districts; School districts, Reapportionment. Effective March 6, 2002 and first applies to the election conducted at the time of the general election of 2002 to elect members of the Union County Board of School Trustees.
