TO AMEND CHAPTER 11, TITLE 16, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO TRESPASS AND UNLAWFUL USE OF PROPERTY OF OTHERS, BY ADDING SECTION 16-11-770 SO AS TO PROVIDE THAT IT IS UNLAWFUL FOR A PERSON TO WILFULLY FLY AN UNMANNED, POWERED MODEL AIRPLANE OR MODEL FLYING MACHINE OF ANY DESCRIPTION OVER THE PRIVATE PROPERTY OF ANOTHER AFTER THE OWNER OF THE PRIVATE PROPERTY HAS FILED A COMPLAINT AGAINST THE PERSON WITH THE SHERIFF OR SHERIFF'S DEPARTMENT OF THE COUNTY IN WHICH THE PRIVATE PROPERTY IS LOCATED, AND TO PROVIDE PENALTIES FOR VIOLATIONS OF THIS SECTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 7 of Chapter 11, Title 16 of the 1976 Code is amended by adding:
"Section 16-11-770. (A) It is unlawful for a person to wilfully fly an unmanned, powered model airplane or model flying machine of any description over the private property of another after the owner of the private property has filed a complaint against the person with the sheriff or sheriff's department of the county in which the private property is located.
(B) A person who violates this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one hundred dollars or imprisoned for not more than thirty days, or both."
SECTION 2. This act takes effect upon approval by the Governor.
