A BILL

TO ENACT THE "SCHOOL TEACHER AUTHORITY ACT OF 2001" BY ADDING SECTION 59-63-245 TO THE CODE OF LAWS OF SOUTH CAROLINA, 1976, SO AS TO PROVIDE THAT SCHOOL TEACHERS SHALL HAVE THE AUTHORITY TO SUSPEND STUDENTS FROM ONE TO FIVE DAYS ON THEIR OWN AUTHORITY FOR VIOLATIONS OF SCHOOL DISCIPLINARY CODES FOR OFFENSES WHICH WARRANT SUSPENSION AND TO PROVIDE THAT STUDENTS SO SUSPENDED SHALL RECEIVE NO CREDIT FOR WORK MISSED AND NO MAKEUP WORK SHALL BE ALLOWED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    This act is known and may be cited as the "School Teacher Authority Act of 2001".

SECTION    2.    The 1976 Code is amended by adding:

    "Section 59-63-245.    In addition to all other school suspension provisions provided by law, public school teachers shall have the authority to suspend students from the teacher's school for a suspension period of one to five school days for a student's violation of the school's or school district's disciplinary code for offenses which warrant suspension on school property or at school or school district sponsored events.

    A teacher suspending a student shall give written notice and a reason on forms provided by the school district and signed by the teacher. Upon filing the suspension notice with the school district's administrative office and after being routed through the principal's office, the suspension shall be effective immediately and shall not be subject to appeal.

    Students so suspended shall receive no credit for work missed and no makeup work shall be allowed."

SECTION    3.    This act takes effect upon approval by the Governor.
