TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-112-55 SO AS TO PROVIDE THAT RESIDENTS OF A COUNTY IN ANOTHER STATE WHICH COUNTY ADJOINS A COUNTY OF THIS STATE IN WHICH A STATE INSTITUTION OF HIGHER LEARNING IS LOCATED SHALL BE ELIGIBLE UNDER CERTAIN CONDITIONS FOR IN-STATE TUITION RATES FOR UNDERGRADUATE COURSES TAKEN AT THAT INSTITUTION IF THE RESIDENT IS ELIGIBLE FOR IN-STATE TUITION RATES IN HIS STATE OF RESIDENCE AS CERTIFIED BY THE APPROPRIATE EDUCATION OFFICIALS OF HIS STATE OF RESIDENCE, AND TO PROVIDE THAT THE INSTITUTION OF HIGHER LEARNING BEFORE GRANTING IN-STATE TUITION RATES TO ANY QUALIFYING OUT-OF-STATE RESIDENT SHALL FIRST ENSURE THAT ALL IN-STATE RESIDENTS WHO MEET THE QUALIFICATIONS FOR ADMISSION TO THE INSTITUTION HAVE FIRST BEEN GRANTED ADMISSION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-112-55. Residents of a county in another state which county adjoins a county of this State in which a state institution of higher learning is located shall be eligible for in-state tuition rates for undergraduate courses taken at that institution if the resident is eligible for in-state tuition rates in his state of residence as certified by the appropriate education officials of his state of residence and if the resident or one parent or legal guardians of whom he is a dependent is employed full time in South Carolina.
The institution of higher learning before granting in-state tuition rates to any qualifying out-of-state resident shall first ensure that all in-state residents who meet the qualifications for admission to the institution have first been granted admission."
SECTION 2. This act takes effect upon approval by the Governor.
