TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 40-13-235 SO AS TO REQUIRE THE STATE BOARD OF COSMETOLOGY TO ISSUE A TEMPORARY PERMIT AS A COSMETOLOGIST, ESTHETICIAN, OR NAIL TECHNICIAN TO A PERSON WHO HAS COMPLETED THE REQUIRED CLASS HOURS, SUCCESSFULLY PASSED THE SCHOOL EXAMINATION, AND PAID APPLICABLE FEES; AND TO PROVIDE THAT A PERSON MAY ONLY PRACTICE IN A LICENSED SALON UNDER THE SUPERVISION OF A LICENSEE; AND TO PROVIDE THAT THE PERMIT IS VALID FOR NINETY DAYS FROM THE DATE OF ISSUANCE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 40-13-235. (A) Upon an individual applying to take the licensure examination, the board shall issue the applicant the appropriate temporary permit to practice as a cosmetologist, esthetician, or nail technician if the applicant has:
(1) completed the applicable class hours in accordance with Section 40-13-230;
(2) successfully passed the final examination given by the school, and the school has provided the examination results to the board; and
(3) paid the temporary permit fee.
(B) A person with a temporary permit may practice only in a licensed salon under the supervision of a licensee in the permittee's area of practice.
(C) A temporary permit is valid for ninety days from the date of issuance; however, if the permittee fails the examination, the permit is revoked immediately upon notice of the failure being provided to the applicant by mail, return receipt requested.
