A BILL

TO AMEND SECTION 34-39-140, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS FROM REGULATION AS A DEFERRED PRESENTMENT SERVICE, AND SECTION 34-41-30, RELATING TO EXEMPTIONS FROM REGULATION AS A CHECK-CASHING SERVICE, BOTH SO AS TO EXEMPT A GROCERY STORE AND A DRUG STORE, AND TO PROVIDE FOR REFUND OF A LICENSING OR INVESTIGATION FEE PAID BY A GROCERY STORE OR A DRUG STORE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 34-39-140 of the 1976 Code, as added by Act 433 of 1998, is amended by adding:

    "(3)    a grocery store, principally engaged in offering packaged food stuffs for retail sale, or a drug store, principally engaged in dispensing for retail sale by a registered pharmacist drugs and medical devices as defined in Section 39-23-20. A grocery store or drug store which has paid a licensing or investigation fee pursuant to this chapter may apply for and receive a refund of all sums paid."

SECTION    2.    Section 34-41-30 of the 1976 Code, as added by Act 433 of 1998, is amended by adding:

    "(3)    a grocery store, principally engaged in offering packaged food stuffs for retail sale, or a drug store, principally engaged in dispensing for retail sale by a registered pharmacist drugs and medical devices as defined in Section 39-23-20. A grocery store or drug store which has paid a licensing or investigation fee pursuant to this chapter may apply for and receive a refund of all sums paid."

SECTION    3.    This act takes effect upon approval by the Governor.
